shipp did legally come unto one Isaacke Merichurch<br />
which 32th parte and of the freight in arreare he the said<br />
Merichurch hath sold to one Mathew Bucke and Mathew Bucke hath sold the same to the [?XXX XXXXXX] and he [?XXX XXXXX] hath sold the same to the said Thomas Middleton<br />
and that the foresaid Josias Best hath since the<br />
beginning of this suite sould one 16th parte of the<br />
said shipp and freight in arreare whereof he was<br />
owner to the foresaid William Austen and the said<br />
William Austen hath since sold the same to the foresaid<br />
Thomas Middleton by reason whereof he the said<br />
Middleton is now owner of five 16th partes and a 32th<br />
part of the said shipp and of 3/16th partes and a<br />
32th part of the freight in question And<br />
they alsoe beleeve that since the voyadge in question<br />
the foresaid Thomas Petty is dead and Thomas<br />
{?ChXXX] is in possession and owner of his two and<br />
thirtieth part of the said shipp And the foresaid<br />
Timothy Musgrave is alsoe deade and John Wood<br />
is owner and in possession of his 32th part of the<br />
said shipp And otherwise these Rendents nor<br />
any of them doe not nor doth beleeve the said<br />
pretended position to be true in any part thereof.
To the fourth position of the said pretended<br />
allegation they answeare and accept the contents<br />
thereof soe farr forth as they make for them and<br />
beleeve that the shipp arlate was and remained<br />
in the service and imployment of the arlate Thomas<br />
Batt for the space of sixteenth (sic) monethes and<br />
twenty five dayes And otherwise saving theire<br />
subsequent answeares which they beleeve to be true<br />
and to which they referr themselves they nor<br />
any of them doe not nor doth beleeve the said<br />
pretended position to be true in any part thereof.
To the fift (sic) position of the said pretended allegation<br />
they and every of them doe answeare and<br />
