since his death his foresaid 32th part of the said
shipp did legally come unto one Isaacke Merichurch
which 32th parte and of the freight in arreare he the said
Merichurch hath sold to one Mathew Bucke and Mathew Bucke hath sold the same to the [?XXX XXXXXX] and he [?XXX XXXXX] hath sold the same to the said Thomas Middleton
and that the foresaid Josias Best hath since the
beginning of this suite sould one 16th parte of the
said shipp and freight in arreare whereof he was
owner to the foresaid William Austen and the said
William Austen hath since sold the same to the foresaid
Thomas Middleton by reason whereof he the said
Middleton is now owner of five 16th partes and a 32th
part of the said shipp and of 3/16th partes and a
32th part of the freight in question And
they alsoe beleeve that since the voyadge in question
the foresaid Thomas Petty is dead and Thomas
{?ChXXX] is in possession and owner of his two and
thirtieth part of the said shipp And the foresaid
Timothy Musgrave is alsoe deade and John Wood
is owner and in possession of his 32th part of the
said shipp And otherwise these Rendents nor
any of them doe not nor doth beleeve the said
pretended position to be true in any part thereof.
To the fourth position of the said pretended
allegation they answeare and accept the contents
thereof soe farr forth as they make for them and
beleeve that the shipp arlate was and remained
in the service and imployment of the arlate Thomas
Batt for the space of sixteenth (sic) monethes and
twenty five dayes And otherwise saving theire
subsequent answeares which they beleeve to be true
and to which they referr themselves they nor
any of them doe not nor doth beleeve the said
pretended position to be true in any part thereof.

they and every of them doe answeare and
beleeve that by the charter party for the
