well remembreth that some dayes before the … well remembreth that some dayes before the says shipps departure<br />
from Cadiz he saw one Raphael da Luna who was the servant of the<br />
acclate Manual Lowij Carnero carry on board the sayd shipp a good pcell<br />
of Indian hides, which hee sayd were his masters, and he consigned<br />
the same to William Claviel att Saint Mallo who does busines as a<br />
factor for the sayd Carnero: And these hides of this deponents knowledge<br />
who went a passenger in the ''S:t Vincent'' came safe to the sayd<br />
Claviels hands, and hee as this deponent is well assured did here<br />
sell the same and convert the proceed thereof in to Linnen Cloath<br />
for accompt of the sayd Carnero: for hee saith that in the moneth<br />
of September 1653 last past hee saw the sayd Claviel goe<br />
on board the arlate shipp the ''Three Kings'' then lyeing att Saint Mallo<br />
where the said ''John de Grace'' did then likewise remaine and saw him<br />
?carry with him three bales of linnen marked as farr as<br />
this deponent can now remember with an R. or some such like<br />
marke, which three bales the sayd Claviel told this deponent then<br />
standing upon the Strand and having goods to lade on board the<br />
same shipp for Cadiz that he did lade for accompt of the<br />
sayd Manuel Levij do Carndro by way of returne of his hides and did<br />
consigne them to the saiyd Raphael de Luna whom this deponent well<br />
knew to be the servant of the sayd Carnero, for which reasons<br />
this deponent is as he saith well assured that the sayd Carnero att<br />
the tyme of lading the sayd bales was and att present is the true<br />
and lawfull owner of the same and XXXXXXX. And further<br />
or otherwise not remembring att present that the sayd Claviel did lade<br />
any Lemmons on board the ''S:t John de Grace'' for the like accompt he<br />
saith he cannot depose
To the third article of the says allegation this deponent saith that after<br />
the lading of the said goods the arlate shipps the ''Three Kings'' and<br />
''Saint John de Grace'' depted therewith from Saint Mallo and in their<br />
Course with their ladings respectively for Cadiz were surprized<br />
and taken by the ''XXXX frigat'' in the imediat service of this<br />
Commonwealth, and the sayd bales of linnen predeposed came into<br />
the possession of the Takers, which he deposeth XXXXXXX a<br />
passenger in the ''Three Kings'', in Company of which and other<br />
shipps the ''Saint John de Grace'' sayled. And further cannot depose-
To the 4th article of the sayd allegation this deponent saith that for<br />
the reasons aforesaid he is well assured that att the tymes of lading<br />
and seizure of the predeposed goods noe ffrenchman or dutch<br />
man subiect of the Crowne of ffrance of States of the united<br />
Provinces had or now hath any right or title to the sayd<br />
goods or any part thereof. And further saving this foregoing<br />
Depositions cannot depose
To the 5th article of the sayd allegation This deponent saith that the arlate<br />
Manuel Lewis Carrero was and is a Spanish borne and a<br />
subiect of the King of Spaine and lives in Cadiz and there<br />
keepesives in Cadiz and there<br />
