A busines of Appeale promoted by the}
proctor of davies against Burgaine}
ffrancklin}

Munday the tenth of Aprill 1654 before doctor
Clerke and doctor Godolphin Judges et cetera in the dining
chamber et cetera in the presence of Samuel howe
notary publique Appeared the said ffrancklin
and exhibited the processe of the Judge a quo et cetera
and protested of his diligence and that he is ready
to give a libell in case he could have the presence of the
said Burgaine or any proctor for him and to proceed
in this cause accordinge to law and Justice./.

A busines of examination of witnesses on the}
behalfe of Nicholas Spury Stephen}
Treveel and Richard Lobb owners of the}
shipp the Walsingham touching the seizure}
of the said shipp by the subjects of the}
King of Portugall ffrancklin}

Which day the said ffrancklin exhibited the
Commission for examination of witnesses in
this behalfe extracted with the depositions of
the witnesses taken by vertue of the
same which the Judges did publish./.

Which day Smith upon the allegation in this cause given and
admitted produced for a witnes Roger Mosse whom the Judges
receaved and administred an oath to speake the truth at the
time of his examination in the presence of Clements dissenting and havinge
the usuall time for Interrogatories./.
