Transcription

1. To the fourth article hee saith and deposeth before theX perfecting
2. and impressing of the said Charter partie there were sewerall meetings
3. by th sewerall of those pers persons that are parties thereunto at
4. the shopp of mr francis Shepard Scrivener in Cornhill (to whom
5. this deponent went then servant) and sewerall debates betweene them
6. concerning the same, and that at the last meeting (whereat hee
7. this deponent beleeveth all the said parties were present) after
8. much consideration and dispute it was unanimously agreed amongst them
9. touching this said voyage as in the said Charter partie is contained, which
10. was thereupon impressed, and by the sewerall parties thereunto, sealed
11. and subscribed and delivered as is nowe to be seene, which soe
12. happened in the presense of this deponent who impressed the same
13. and was to be witness to the said sealing and deliverie, and indorsed
14. his name as a witness thereunto as nowe appeareth by both the
15. parts which hee hath now shXXX shXXX. And further hee saith that
16. hee verily beleeveth that it was the intent true meaning and agreement
17. of all the said parties that the said waters and company should not
18. pay any freight for their said proportions of tonnage taken in the said
19. shipp, untill the said shipps safe arrivall, and right discharge of
20. her lading in the port of the river of London, for that in and by
21. the said Counterpartie is expressely soe declared. And otherwise
22. (referring himselfe to the said Charterpartie) hee cannot depose.

23. To the fifth article hee saith and deposeth that the draught of the
24. said Charterpartie was ˹at˺ upon the fore said sewerall meetings from
25. time to time altered and amended, and at the said last meeting fully
26. agreed upon as in this deposition to the next precedent wtnesse is more
27. fully set forth. And otherwise saving his foregoeing deposition
28. hee cannot depose.

29. To the 6th hee cannot depose.

To the Interrogatories [CENTRE HEADING]

33. To the first hee saith hee knoweth the said william harris and
34. Thomas Bowyer, and hath soe donne XXXXXX the said making of the
35. said Charterpartie and about halfe a yeere before, and saith that mr
36. Massey and mr webb asked him if hee remembred any respite or demurrer
37. concerning the said Charter partie (before the impressing thereof) touching
38. the s time when the freight should be due, or and (showing him the said Charterpartie) asked him whether his name on the back thereof was
39. of his hand writinge, and whether hee impressed the said Charterpartie
40. or not, to which hee answered affirmatively, saving as to the said first
41. question, hee answered that X it being six yeares since hee could not
42. call the particulars to minde, otherwise than as in the said Charterpartie
43. but remembred that ther had bin sewrall meetings thereabouts, or to
44. that effect, and otherwise negatively.

45. To the second hee referreth 3. 4. and fifth Interrogatories hee and the Schedule and Charterpartie annexed hee referreth himselfe to his foregoeing deposition
46. and to the said Charterpartie, and otherwise hee cannot depose nor remember
47. it being soe long since, saving hee remembreth there was noe other writing
48. made or sealed at mr Shepards (nor elsewhere to his knowledge) betweene the
49. said parties touching the said shipps hire or freight, saving the before mentioned
50. Charter partie.
