Which day the said Suckley<br />
alleadged that the said Cheeke<br />
hath given a libell in this<br />
cause in the Acts of this Court<br />
longe since but hath not brought in<br />
the same Wherefore hee prayed the<br />
said cause to bee dismissed with expences in<br />
the presence of the said Cheeke consenteinge to<br />
the dismission of this cause in case hee shall not<br />
give in his libell into the Registry of this Court<br />
by Munday next at noone Whereupon the Judges did<br />
exXXXXXX etcetera dismisse this cause with expences in<br />
case the said Cheeke shall not leave the said Libell<br />
in the Registry of this Court by Munday next att<br />
noone./

might bee ordered by this Court<br />
to pay and satisfy unto the said Scott<br />
and the rest of the marriners of the<br />
shippe the {BLANK IN ORIGINAL MANUSCRIPT} their respective wages<br />
due for their service in the said shipp the voyage<br />
in question in the presence of the said Suckley appearing<br />
for the said Swan and makinge himselfe partie for<br />
him dissentinge and alleadging that one William<br />
Whittle was the freighter of the said shipp the<br />
voyage in question whoe refuseth to pay the freight<br />
sue for the said shipps service the voyage in question<br />
whereby hee is disabled for payment of the marriners<br />
wages, Whereupon the Judges at Suckleys petition<br />
did decree the said Whittle to bee monished to appeare<br />
in this place upon wednesday next in the afternoone<br />
to show cause if any hee hath why hee should not pay<br />
the freight due for the service of the said shippe the<br />
voyage in Question that thereby the said marriners<br />
may bee paid and satisfyed such wages as the Court<br />
shall thinke fitt to adjudge unto them and att Cheekes<br />
petition the Courte did assigne to heare this cause<br />
the same time in this place and monished the said<br />
Swan to bee then and there present./.<br />
