said Baker exhibiting for the said Stubbs and making himselfe party for<br />
him not beleeving the same to be true the Judges assigned the said<br />
Suckley to prove the same the thir Court day from hence and decreed for the<br />
said Stubbs his answeare the third day after if et cetera./

said shipp to be appraised by Comissioners to be named on<br />
both sides in case the said Colequite shall name Comissioners<br />
by to morrow noone intimation beinge in the meane time given unto him and<br />
the said appraisement being made the Judges at the further petition<br />
of the said Suckley did decree the said shipp to be repaired and<br />
sett to Sea at the proper costs and charges of the said drakeford<br />
Standen and company upon security in the like cases usuall in case noe cause<br />
be shewed to the contrary by Colquites Clients by wednesday next at noone
A generall continuation of all causes and certificates}<br />
untill the last Certificate of thsi Tearme}
Which day the Judges did continue all causes and<br />
certificates this day assigned and continued in which<br />
noe Acts are this day particulerly [?specified] and all<br />
certificates this day to be brought in and which are not<br />
returned in the same state that now they are untill the<br />

in the burrough of Southwarke Baker and William<br />
Parish of Redriffe in the County of Surrey marriner whoe<br />
submitting themselves et cetera obliged themselves et cetera for the said Gold<br />
and Babb in the summe of 60 ''li'' of lawfull money of England to the<br />
said George Blowers and company to answer the action in this<br />
behalfe commenced against the said shippe and to pay what they shalbe condemned<br />
in with expences of suite in case they shalbe overthrowne And unles<br />
et cetera Which caution the Judges receaved and decreed the said shipp to be<br />
released from the arrest Then the said ffrancklin under protestation not<br />
acknowledginge any dammage to be done to the said shipp the ''Talent'' or<br />
any thinge to be due to the said Blowers and company but to avoid<br />
further vexation and suite he tendred xx ''s'' for the pretended dammage and<br />
vj ''s'' for the expences which he left in the Registry of this Court./.
