Transcription 28. January 1660./ Ex parte Hall quoad th28. January 1660./ Ex parte Hall quoad the ''James''}<br /> Hall.} Super Allgeatione paed Examinatus./. '''Rp.''' '''2dus.''' '''Major Charles Stevenson''' of Edenborowe in<br /> Scotland Esquire aged 63 yeeres or thereabouts sworne<br /> and Examined saith as followeth./. To the 1. 2d. 3d and 4th articles of the said Allegation, hee saith that, hee this<br /> Deponent well knoweth the shipp the ''James'' arlate whereof Robert Hall<br /> was Captaine ) in the yeeres 1648 and 1649. Shee belonging then to Leith<br /> neere Edinbrowe aforesaid where this Deponent was borne, And saith <br /> that hee the said Robert Hall ws then a quarter part owner of the said<br /> ship, as this Deponent was Credibily informed. And saith that in one<br /> of the said Yeeres this deponent was at the Isle of Orkney by<br /> the Lord of Canoole and other Noblemen and Officers of his Majesty<br /> there, put onboard the said ship ''James'' as Major, to goe in her to<br /> seeke for the Truely noble and Valiant Marquesse of Montrosse to receive order from<br /> him, And saith that before his coming aboard her and after, hee<br /> this Deponent sawe the Commission granted by his majestye that nowe<br /> is to the said Robert Hall, by which Commision the said Hall was with<br /> the said ship ''James'' to followe the order of the said Marquesse of<br /> Montrosse, And saith that the said ship sailing from Orkney<br /> for Hamborowe where they understood the Marquesse of Mon[?XX]<br /> then was, and coming upon the Coast of ffreisland shee was<br /> by foule weather driven to the Harbour of Docam in<br /> ffreisland, and soone fafter her coming thither the foresaid<br /> Robert hall the Captaine of the said ship, and some others<br /> that came thither in her went thence overland for hamborowe<br /> to speake with the Marquesse of Montrosse [ADD DATA] To the 5th and 6th hee saith that the said ship being soe seized the alate<br /> Sir William Mackdowell his Majestyes agent at Greoning in ffreisland<br /> and alsoe his precontest Mr Leith did solicite the<br /> Lord of ffreissland about getting the said ship released, and showed<br /> them the foresaid Commission granted bu his said Majesty to the said<br /> Captaine Hall, and many other Evidences and Testimonyes shew<br /> ing clearely that the said ship sailed with his said Majestyes<br /> Commission and was a ship in his Majestyes service uner the Marquesse<br /> of Montrosse, As this deponent after his coming out of prison heard him<br /> affirme, but notwithsatnding shee and all that shee had onboard her were condemned as a prize<br /> (andwere condemned as a prize<br /> (and  +
