or thereabouts sworne and Examined
To the first and second articles of the said Allegation hee<br />
saith that a while after Michaelmas 1658 the ship<br />
the ''John'' whereof one Marriot was master and the ship<br />
the ''Mary Rose'' whereof one John Cole was then<br />
master did both lye at Anchor in Tinmouth haven<br />
and many other ships the same time did there<br />
ryde at Anchor some ahead, and some asterne<br />
of the ''John'' and ''Mary Rose'' and most of the said<br />
other ships did weigh and set saile out<br />
of the said haven the same morning that the<br />
''John'' and ''Mary Rose'' weighed to set saile then<br />
(but the particular day hee remembreth not) and some<br />
of the said other ships weighed and set saile out<br />
of the said haven before the ''John'' and ''Mary''<br />
''Rose'', and some after them and saith the said ship<br />
''John'' and ''Mary Rose'' weighed Anchor to saile thence about the<br />
same time but the ''John'' hee saith was ahead of the<br />
''Mary Rose'' a little space and after the ''John'' had sailed<br />
a little space directly forward shee sheered over to<br />
the Southward, and the said ship ''Mary Rose'' sailing<br />
directly forward the ''John'' sheering from the southward<br />
againe toward the Northward came foule of the ''Mary''<br />
''Rose'' as she was sailing in her direct Course and<br />
the foot shrouds of the the ''John'' came foule of Boltsprit<br />
of the ''Mary Rose'' and the Anchor of the ''Mary Rose'' catched<br />
one of the Laniards of the maine shroud of the ''John'' The<br />
Premisses hee deposeth being a foremast man of the<br />
''Mary Rose'' the said time and was an Eye witness<br />
of the same, And further cannot depose to theise<br />
articles.
To the 3rd 4th and 5th he saith that hee doth not knowe<br />
that the Boate of the ''Mary Rose'' was towing her<br />
when the ''John'' came foule of her as aforesaid, And saith<br />
the Company of the ''Mary Rose'' did their Endeavour to<br />
keepe cleare of the ''John'', and never said (that hee<br />
knoweth of) that they would not slacken their sailes or<br />
let fall an Anchor, neither were they soe desired to doe by<br />
the master or any of the Company of the ''John'' this deponent knoweth of<br />
