laden with goods and merchandises of the said parts of Brazeele<br />
but had not any other particular knowledge of or privity to her said<br />
Lading then by credible relation as aforesaid at the said place<br />
of fernambuco being the place of such the said shipps lading, And<br />
further to this article hee deposeth not./
To the 4th article of the said Allegation he saieth, That it is publique<br />
and notorious, and that he this deponent is absolutely and undoubtedly<br />
convinced and assured, That the sugars Tobaccoes and Brazeele<br />
wood whereof the said shipps Cargaison consisted did growe<br />
and were made at or in fernambuco aforesaid and other parts<br />
of the Brazeele, which at the time of the making and<br />
growing of the said wood and sugars and at the time of the lading<br />
and putting of the same on board the said shipp were and are<br />
in and under the Dominions territories subjection and obedience<br />
of the said Crowne of Portugall, and that the people inhabiting<br />
the said places were and are all of them Subjects of the said<br />
king and for and as such commonly accompted reputed and taken<br />
for all the time wherein this deponent hath used the said navigation<br />
and trade as aforesaid. And further he deposeth not/
To the 5th article he saieth, That hee this deponent doeth onely<br />
generally knowe the factors and Agents of the Brazeele<br />
Companie residing at and about ffernambuco aforesaid, by<br />
whom the said Cargaison of Sugars Tobacco and Brazil<br />
wood were laden in and on board the said ship ''Nostra''<br />
''Seniora de Rosario Saint Gonsalvo'' as aforesaid, and that they<br />
the said ffactors in the yeare of our Lord 1657. aforesaid, and<br />
in the moneths therein respectively concurring, and especially at<br />
and about the time of the lading of the said shipp and for<br />
sometime before were at ferbambuco aforesaid generally knowne<br />
and reputed to live and reside at ffernambuco aforesaid or some<br />
other parts thereabouts in the Dominions of the said king and to<br />
be all and every of them Subject unto the said Crowne of Portugall<br />
and for and as such by publique voyce and fame reputed owned<br />
and esteemed at fernambuco aforesaid, as this deponent hath received<br />
of and from very credible testimony in those parts, and doeth assuredly<br />
beleeve the same. And further to this article he deposeth not/
To the 6th article hee saieth, That undoubtedly and of necessary<br />
consequence, as hee apprehendeth, and hath constantly conceived and<br />
apprehended, the said shipps lading of Sugars Tobacco and<br />
Brazeele wood aforesaid was soe Laden and putt on board<br />
