''Gonsalvo'' at the Brazeele aforesaid, there were severall<br />
bills of Lading all of one tenor (to witt for each distinct prop[?XXX]<br />
of particular goods) signed for the same by this deponent as Master<br />
of the said shipp, and that some of the said bills of ladinga nad<br />
also diverse other papers Invoyces Letters and other writings<br />
which concerned the said shipp and her lading were brought<br />
in the said shipp from ffernambuco aforesaid, and did come<br />
to the hands of the said seizors or of some of them who violently<br />
seized the same, and threw a great part of them overboard in<br />
this deponnets sight and presence, Which bills of Lading were to<br />
hav ebeene delivered to severall persons in Lisbone to whom the<br />
said goods were severally to be delivered, and that by meanes<br />
of the said seizure and imbeazeling of the said [XXXXXX GUTTER]<br />
an dfor that ther eis no conveyance from Lisbone to London<br />
by the ordinary Poast, but onely by Sea, (which is long and<br />
uncertaine conveyance) the distinct dpecificall and particular<br />
proprietie of every person in the said goods severally interessed<br />
cannot for the present be dist[?inc]t specificall and particularly<br />
propertie of every person in the said goods severally interessed<br />
cannot for the present be distinctely (sic) and specifically sett d[?owne]<br />
as this deponent conceiveth it to be obvious to any ordinary est[?XXX]<br />
or judgement And further to this article deposeth not/
To the 11th he saieth, That the said shipp ''Nostra Seniora da''<br />
''Rosario Santa Gonsaloe'' with all the rest of the sugars and<br />
other goods on board her, which was not, as aforesaid taken<br />
or plundered out of her by the said seizors or some of them<br />
have by the said Captaines Commandes and Companies of<br />
the said dutch shipps or by some of them, where, the proprietie<br />
of the same remainibg and being stille in the said Brazeele<br />
Companie and others the Subjects of the said king, the same<br />
have at their suite beene arrested by warrant of this Court<br />
as belonging unto them in poynt of proprietie, and have been<br />
since by oder of the same Court unladen out if the said shipp<br />
and the quantities numbers and markes of the same have bin<br />
returned into the said Court, as this deponent beleeving doeth and<br />
may appeare in and by the Acts and proceedings of the [?same]<br />
whereunto this deponnet for his full cerytainty herein doeth referr<br />
himselfe. And further to thsi article deposeth not/.
To the last hee saieth his foregoeing deposition is true.
