Masters letter and affirmation by word of mouth the said<br />
Policarpio de Oliveira at the time of the buying lading or<br />
seizure of the said severall goods had not any share or interest<br />
therein, he being onely the factor and Agent by his said<br />
Principalls intrusted and employed to and for the buying<br />
providing and lading of the said goods, according to the Orders<br />
he had received of and from his said principalls to the effect aforesaid and not<br />
otherwise. And further to this Article hee saith<br />
he cannot depose./
To the 9th article of the said Allegation he saieth, That hee well<br />
knoweth, That the said Antonio fernandez Carvajal (to whom<br />
this deponent hath in the quality aforesaid related by the space of<br />
five yeares last past and upwards) was and is a Merchant of<br />
this City, and here doeth live and keepe his wife and family<br />
and is a Subject and free denizen of this Commonwealth, this<br />
DEponent having seene and perused his letters of denization, and<br />
for and as such the said fernandez was and is generally knowne<br />
and accompted in this said City of London, ever since this<br />
deponent hath knowne him as aforesaid, and for many yeares before<br />
by common reputation And further to this article hee<br />
saieth he cannot depose/:-
To the 10th Article of the said Allegation, hee saieth, That by like<br />
advise as aforesaid from the said Policarpio sent to the said<br />
Antonio fernandez, this deponent hath seene and observed that,<br />
the said shipps said lading of dry fish did produce at Porto a<br />
Porto aforesaid the summe or value of three thousand pounds sterling<br />
or thereabouts, And he further saieth, That hee is well<br />
assured, That the said Antonio fernandez Carvajas standeth<br />
ingaged to pay for the fraight and hire of the said shipp<br />
the ''New England Merchant'' for the said Voiage the summe<br />
of eight hundredpounds sterling according to Charterpartie, which this<br />
deponent hath seene and perused, and that he is further engaged<br />
tp pay for teh said shipps demmurrage at Porto Porto during<br />
the said seizure and detention there, which he beleeveth will<br />
amount to the summe of two hundred pounds more or therea=<br />
bouts. And further to this Article hee saieth hee cannot depose/
