To the 11th hee saith hee being master of … To the 11th hee saith hee being master of her the voyage in<br />
question knoweth that the ''Mary and Joyce'' did come from Barbary<br />
to the Canaries and that the arlate Thomas Warren had a great<br />
interest in a great quantitie of wines which were laden aboard<br />
the sayd shipp about the same tyme the sayd forty pipes of wine were<br />
laden aboard her by the sayd de herrera as aforesayd And saith<br />
the arlate William Warren the brother of the sayd Thomas went<br />
Supracargo of the sayd shipp the voyage in question And further<br />
hee cannot depose/
To the 12th 13th 14th and 15th articles of the sayd alleagtion hee saith<br />
that the sayd forty pipes pf wine being as aforesayd laden by<br />
the sayd da herrera at Oratava aboard the ''Mary and Joyce'' shee<br />
departed thence with them and other her ladeing of wynes and<br />
other goods bound for London and in her course thitherwards<br />
was with the sayd forty pipes of wine aboard her and other her<br />
ladeing seized by two men of warr Commissioned (as the<br />
Captaines and Companyes gave out) by the King of Spaine for<br />
seizing the shipps and goods of the subiect sof the Commonwealth<br />
of England, of which ffrigotts the arlate Jacob Bolart and<br />
John Van Sluce were or gave out themselves to bee Commanders, and as they sayd and gave<br />
out the sayd ffrigotts belonged to dunkirke and Ostend, which<br />
Captaines with their sayd ffrigotts having made seizure of the<br />
''Mary and Joyce'' and the sayd fforty pipes of wyne and other her lading<br />
neere the North Cape carried her and her lading and Company<br />
aboard her into the Groyne in Galisia And further to those<br />
articles hee cannot depose of certayne knowledge for that hee was<br />
gone from the Groyne (before the wynes arlate or any of them<br />
were taken out of the ''Mary and Joyce'' and put aboard the ''Elizabeth'' arlate)<br />
a passenger in a fflemish shipp for Rotchell, but saith hee<br />
verily beleeveth divers of the wines laden aboard the ''Mary and''<br />
''Joyce'' and amongst others the sayd fforty pipes soe laden by the<br />
sayd de herrera Leyva or a great part of them were put aboard<br />
the ''Elizabeth'' and shee surprized with them aboard her by some<br />
shipp belonging to the Commonwealth of England for that<br />
hee coming from Rotchell to London sawe a shipp called the<br />
''Elizabeth'' lying in the River of Thames with a great many<br />
of the sayd forty pipes of wyne soe laden by sayd de herrera<br />
aboard the ''Mary and Joyce'' at the Canaries and other<br />
wines aboard her, and having the same markes upon them as<br />
aree same markes upon them as<br />
