twenty eight yeares or thereabouts a wittnesse sworne<br />
and examined saith as followeth./
To the first and second articles of the sayd alleagtion hee saith<br />
that at the tyme of the seizure and confiscation of the ''guift'' of<br />
Topsham arlate hee this deponent was a factor at Bilboa for James Marshall arlate one<br />
of the parties in this cause and thereby knoweth that before such<br />
her seizure hee this deponent had there laden aboard the sayd shipp<br />
for Accompts of the sayd Marshall two hundred kintalls of Iron<br />
or thereabouts and that there was divers kintalls more of Iron laden<br />
aboard the sayd shipp by one Gregory Westcome factor there to the<br />
arlate Thomas Pitt, for Accompt of the sayd Thomas Pitt and Company<br />
of mariners sufficient to navigate and conduct her in her sayd homewards<br />
voyage, and had receaved her disptaches for the sayd voyage but by<br />
reason that there was certayne silver videlicet peeces of eight in a considearble value which<br />
(as it was at Bilboa reported) did properly belonge to [BLANK IN MANUSCRIPT] Ma[?re]<br />
the Master of the sayd shipp the sayd shipp was there seized on with<br />
the sayd ladeing of forty tonne of Iron aboard her to the preiudice<br />
of the sayd Pitt Marshall and Company the Owners and Proprietors<br />
thereof, and the sayd shipp and the sayd forty tonnes of Iron by reason<br />
of such seizure were in the Custody of the King of Spaines Officerss<br />
for the space of two or three moneths or thereabouts by which meanes<br />
much of the victualls and provisions of the sayd shipp was spent consumed<br />
and taken out of her by the sayd Kings officers and some of the sayd<br />
shipps tackle taken out of her and imbeazelled by the sayd Officers to the<br />
preiudice of the Owners of the sayd shipp And further to those articles<br />
hee cannot depose/
To the 4th article of the sayd alleagtion hee saith that upon seizure of<br />
the sayd forty tonnes of Iron hee this deponent as factor for the sayd<br />
Marshall and the sayd Gregory Westcomb as ffactor for the sayd Pitt did<br />
on behalfe of the sayd Pitt Marshall and company inyeressed in<br />
the sayd forty tonnes of Iron clayme the same on thir behalfes and<br />
after a suite in lawe did by decree of Court recover the sayd Iron<br />
in which suite there was necessarily expended fifteene pounds sterling<br />
