'''Roger Kilvert''' of London Merchant aged 67. yeares<br />
or thereabouts sworne and examined deposeth and<br />
saith as followeth videlicet
To the first article of the said allegation hee saith and deposeth<br />
that the exportation of plate and Bullion from any part or place<br />
in the Kingdome of Spaine is absolutely forbidden by the lawes<br />
of that Countrey and noe man may lade and export any without<br />
special license for the same, and whatsoever parcells shalbe found<br />
laden without License and seized shalbe lyable to confiscation<br />
which hee knoweth having as a Merchant lived 20. yeares in that<br />
Countrey ended about 27. yeares since, and having ever since traded<br />
thither, and being by that meanes well acquainted with the Customs<br />
and Lawes of that Countrey, in the matter of ladeing of silver<br />
and plate. And saith that hee this deponent hath knowne when<br />
many parcells of silver have bin seized and apprehended in<br />
the parts and ports of Spaine within those fortie yeares last past<br />
and that such parcells have bin condemned for confiscate<br />
but doth not know that any person did suffer death for the<br />
crime of exporting his owne money. And further cannot depose
To the second and third articles hee saith and deposeth that for the<br />
discovery of those who export plate without License the Judges in<br />
Spaine search Merchants bookes and writings and Closetts and die<br />
alsoe search many shipps that are ready to sett saile to find out<br />
the bills of ladeing or the Pursers bookes, which may discover the<br />
offenders in this kind and for prevention in these cases mmany<br />
Merchants put into the bills of ladeing the Laders by feigned<br />
and unknowne names, and many make bills of ladeing with<br />
blancks as to the name of the Laders: but the contents of the<br />
plate laden and the parties to whome consigned is usually plainely<br />
expressed. And this hee knoweth for the reasons aforesaid And<br />
further hee cannot depose/
To the fourth hee saith that hee this deponent cannot particularly<br />
expresse any parcells of plate to be laden and exported from Spaine<br />
for the accompt of hollanders, but it is generally beleeved that they<br />
doe export good store aswell as the Merchants of other Nations<br />
and further cannot depose.
To the 5th hee saith that hee this deponent doth not know of any<br />
such colourable Bills of ladeing to be made for the securing and<br />
redeeming any such Goodes from danger, though it hath bin usuall<br />
and accompted iust and right soe to doe. And further deposeth not

more then the generall opinion and receiving in holland when by<br />
this or any other meanes they have escaped a danger And further<br />
cannot depose.
