Transcription To the 6th article hee saith, that after tTo the 6th article hee saith, that after the shipps aforesayd were surprized<br /> this deponent was present with the arlate Captaine Phillips at Portsmouth<br /> and sawe the arlate Bayley and divers of the parties in this suite come and<br /> in a mutinous and tumultous waye seize upon the person of the sayd<br /> Isaack Phillips and use many threats and violences to him and by force<br /> carrie him before the Governour of Portsmouth and before the sayd Governour<br /> accuse the sayd Captaine Phillipp that hee had cheated and cozened them or<br /> to that effect and demanded of them their thirds of the prizes aforesayd<br /> taken by the ''Constant'' whereto ther sayd Captaine Phillips replyed and sayd<br /> whome will ye appointe to receive the same, or words to that wffect, to which<br /> they answered they would have Captaine hurley and John Searle (meaning<br /> the arlate Captaine hurley and John Searle) to receave the same, and that if<br /> it were paid to them the sayd hurley and Searle, it should bee all one or<br /> as well as if it were payd to them selves or they then spake words to the<br /> like effecte in the presence of this deponent and the sayd Governour and divers<br /> others whose names hee now remembreth not And further to this article<br /> hee cannot depose./ To the 7th hee saith hee well knoweth that after the premisses the sayd Isaack<br /> Phillips did signe a bill for payment of certaine money to the arlate<br /> William hurley for the use of himselfe and the rest of the mariners of<br /> the ''Constant'' in liewe of their thirds of the prizes taken as aforesayd<br /> by them but what the summe of the sayd bill was hee now remembreth<br /> not And further to this article hee cannot depose./ To the 8th hee saith hee heard the arlate Bayly and alsoe the sayd<br /> Captaine hurley order the sayd Phillips to pay moneys for cloathes<br /> meate and drinke and other necessaries which the Mariners of the ''Constant''<br /> did in Portsmouth and other places thereabouts, and the sayd Phillips<br /> promised to pay the same, but what it amounted to or whether hee paid<br /> the same hee knoweth not And further to this article hee cannot depose/ John Greene [SIGNATURE, RH SIDE] ******************************** The sayd '''John Greene''' upon the allegation<br /> given in on the behalfe of the sayd Phillips in the<br /> second place./ To the first and second articles of the sayd allegation hee saith and<br /> deposeth that after the arlate shipp the ''Constant'' had finished all<br /> the voiages arlate the arlate Captaine hurley and the arlate Bayley<br /> in the behalfe of himselfe and the rest of the parties in this suite on the<br /> one part and the arlate Captaine Phillips on the other part did cause<br /> this the other part did cause<br /> this  +
