did breake and spoile a Cable belonging to the ''Switzer'' worth [?twenty]<br />
five pounds sterling at least And further to this article hee cannot depose/
To the 7th and the schedule therein mentioned and now read<br />
to this deponent at the tyme of this his examination hee saith it doth conteyne the<br />
severall parcells of goods which were in the shipp the ''Switzer'' when shee<br />
was soe seized and alsoe the quantitie of Livers which each parcell<br />
was to pay at haverdegrace for freight, and each parcell was to have<br />
paied the quantitie of livers therein specifie for the same And further<br />
to this article hee cannot depse./
To the 8th hee saith that at the tyme of the sayd shipps seizure<br />
aforesayd shee had on board her besides the goods claymed by the sayd<br />
Zollicoffers and the sayd Scothering forty chests of soape belonging<br />
to him this deponent and his sayd shipps Company and a parcell of<br />
ffustick wood which belonged to this deponent and his Owners and was used<br />
for stowage, and alsoe a great quantitie of soape and oyles belonging to<br />
other persons as by the schedule in the next precedent article mentioned<br />
doth and may appeare And further hee cannot depose./
To the last hee saith his foregoeing deposition is true/
To the Crosse Interrogatories/ [CENTRE HEADING]
To the first Interrogatorie hee saith hee was Captaine and aboard the ''Switzer'' at her<br />
seizure and hath bin Captaine of her from the tyme of her being bought<br />
as aforesayd at Marselles and was borne at hamburgh where hee hath<br />
lived all his life tyme And saith hee is not of Kinne to any of the Claymers<br />
nor related to them otherwise then as hee was Master of the sayd shipp<br />
And that hee hath a two and thirtith part in the sayd shipp and is<br />
owner of sixe chests of soape of those 40 chests sayd as aforesayd<br />
to belong to him and the shipps Company And further hee cannot answere/
To the 2d hee saith hee hath knowne all the Zollicoffers Interrogate<br />
(the foresayd Mathias excepted) for these 20 yeares last past<br />
and saith by Common repute they were and are Switzers borne at Saint Gallo<br />
in the protestant Cantons there, And hath knowne the Interrogate Langerman<br />
and Scrothering for these 20 yeares last or thereabouts and saith they are both<br />
Hamburgers by birth and habitation and have there lived during all<br />
the tyme Interrogate and further hee cannot answere/
To the 3 Interrogatorie hee saith the sayd shipp was bought at Marsellis above three<br />
yeares since, but saith hee was not present at the buying of it or paying any<br />
of the money for it nor knoweth of any bill of sale for the same and beleeveth<br />
that the same shipp doth not belonge to any ffrenchman but belongeth<br />
really to the Claymers (save a two and thirtith part thereof which belongeth to him this deponent) and that their names are not used to colour any<br />
[?frends] in the sale thereof and further saving his foregoeing deposition hee<br />
