To the first Interrogatory hee saith hee cometh to testifie the truth of this<br />
knowledge in this cause without any order from this court only upon<br />
request of the producents who beare his charge saving that hee beareth<br />
his share as a tennant of all charges touching the presentation<br />
of this suite, and saith hee is a fisherman of ffeversham and useth<br />
to fish upon the grounds in question and desyreth that these teXhoXe<br />
the same doth by laws and right belong may prevaile in this cause<br />
and saith that if the ffeversham men prevaile in this cause hee shall<br />
retayne his priviledge as a tennant to fish the grounds in controversie?<br />
excluding all other fishermen of other places, and if they be overthrowne<br />
therein hee shall loose the sayd priviledge which is a great part of<br />
his livelyhood And further to this Interrogatory hee cannot answere/
To the 2 hee saith hee hath bin a ffisherman (master and prentice?) for these<br />
thirty yeares last past and saith the places Interrogatory lye within the ebbing<br />
and flowing of the sea and us only a smale River and XXX arme of the sea<br />
as hee beleeveth, and saith the same is about a myle in the largest<br />
place over at high water from shoare to shoare, and at lowe water not<br />
above a quarter of a myle broad where it is broadest and saith hee<br />
well knoweth that the sayd River is soe shallowe at the entrance thereof<br />
from the sea that it will not admitt any shipp of such brethen? as is<br />
Interogate in to the same to ride there it being not above seaven? foote? GUTTER<br />
deepe at lowe water at springe tymes, and at some tymes lesse and that hee never sawe<br />
nor knew that any shipp of great brethen or of such brethen as is Interogate<br />
did not ride there And further saving his foregoing deposition<br />
wherein hee hath satisfied the rest of this Interrogatory hee saith hee cannot<br />
depose./
To the 3 Interrogatory hee saith hee was never at any Vice Admiralty court<br />
held in Kent And further hee cannot answere to this Interrogatory other? GUTTER<br />
than negatively well knowing being waterbayly as aforesayd that the ffishermen tennants of the<br />
mannor and hundred of ffeversham doe yearely in the Court held for<br />
the Lords of the sayd mannor and hundred of ffeversham (of which court<br />
none but ffishermen tennants of of the sayd mannor and hundred doe<br />
or can forme of the jury) sett out and appointe the…<br />
when the grounds in question shall be layed in or broken open and<br />
punish offenders against the sayd orders nor having heard or<br />
beleeveing that any Vice Admiralty court or any but the sayd<br />
Lords court did ever sett out or had any power to sett out or GUTTER<br />
orders touching the sayd grounds./
To the 4th hee saith hee beleeveth the ffishermen of Stroude Milton and<br />
other places have within the tyme Interrogate in…prepose?<br />
ffished upon the grounds Interrogatory And to the rest of the Interrogatory hee answere<br />
negatively for his part having never heard of any such complaint<br />
or order as is Interrogate./
To the 5th hee saith hee can read, but not write nor read written<br />
