Transcription To the first article of the sayd Libell heTo the first article of the sayd Libell he deposeth and<br /> saith that he this deponet was very well acquainted with<br /> the arlate John Mare in the time arlate, and he saith<br /> that within the said time and more especially within the<br /> moneths of May and June 1653 he the said Mare<br /> was Master or Commander of the arlate shipp the<br /> ''hope'' of London, and had the care and government of her<br /> The premisses he deposeth because that the said Mare as Master of the said [?shipp] did<br /> make an offer unto him this deponent to goe along with<br /> him in the said shipp as one of the said shipps<br /> Company in the voyage for which she was then bound<br /> And further he cannot depose To the second article of the said Libell and to the schedule therein<br /> mentioned he deposeth and saith that he this deponent was<br /> in the yeares 1652 and 1653 fforeman of the shopp of<br /> the producent, and that in the moneth of ffebruary 1652<br /> [?inXXX] et cetera (to his best remembrance) the said John Mare<br /> came first to the producents shopp and bespoke certaine<br /> iron works for the use and for the repayring of the<br /> arlate shipp the ''hope'' of London she then lying in the<br /> River of Thames, and he saith that the said schedule being<br /> now read over unto him, he well knoweth that all the<br /> particulars mentioned in the said bill or schedule were at the bespeaking<br /> of the arlate John Mare and at his desire made, provided<br /> and delivered for the said shipps use and for her<br /> necessary reparation unto the sayd Mare or sucn as<br /> came in his name and by his order for the same, and he<br /> further saith that although he doth not know whither there<br /> was any certaine bargaine or contract made betweene the<br /> said Mare and the producent for the prices of the particulars mentioned<br /> in the said schedule, yet he saith he well knoweth that<br /> the particulars are really, honestly and concionably worth<br /> the severall values and rates at which they are valued<br /> and rated in the said schedule, And further he cannot<br /> depose. To the third article he deposeth and saith that the producent<br /> hath assisted the shipp arlate, which he beleiveth he would<br /> not hath done, could he hath gott his money by [?faire]<br /> meanes And further referring himselfe to the Registry<br /> of this Court he cannot depose. To the fourth article he deposeth that the producent did<br /> presently after the delivery of the goods schedulate for the [?use]<br /> of the shipp arlate, tell this deponent that his bill came<br /> unto 21 ''li'' odd moneys, And he saith that the said<br /> producent hath bin much dammaged in not receiving the<br /> money due and owing unto him for his said goods [?XXX]<br /> he saith he cannot estimate the said damage, And<br /> further cannot depose. To the fifth he cannot depose, not knowing the arlate<br /> Greene and Coxe To the sixth article he referreth himselfe to the Lawe<br /> and further cannot depose.
