Bayonne in ffrance, and that by this deponents direction as gacing an<br />
order to that purpose from the said producent, and saith that shee thence<br />
proceeded to Mallega upon the Voiage in Controversie, her said first setting<br />
out from Middleborough (as predeposed) being before any hostility broke<br />
forth betweene the English and dutch Nations, And saith that<br />
although the said shipp and goods were ordered and designed upon the<br />
Voiage in question to returne and come to Zeeland, yet the said<br />
shipp and goods were in trueth and realitie to bee disposed of by this<br />
deponent to and for the said producents use and accompt, according to<br />
such orders and directions as hee this deponent upon their arrivall<br />
should receive from the said producent, for and concerning the disposall<br />
thereof And that this deponent was either to have sent the said goods<br />
to Ostend to the said producent, in kind, or otherwise according to<br />
his order and for his sole accompt to have sold or disposed of the same<br />
to the producents best benefitt and advantage. The premisses hee<br />
declareth upon his oath Conscience and salvation to bee reall<br />
and true, as having infallible knowledge thereof by meanes of the<br />
trust reposed in him, and his employment in and for the said<br />
producents affaires, and particularly this before declared in and<br />
during the said producents absence and exile as aforesaid. And<br />
further hee cannot depose:-/
To the 5th hee saith, That the said daniel Thyson the producent<br />
in this Cause was and continued a Burgher in and of Terveere<br />
in Zeeland and a Subject of the States of the United<br />
Netherlanads till about the moneth of September <u>1651</u> at<br />
which time by publique Sentence and proclamation from the<br />
Lords or Magistrates of Terveere aforesaid hee was totally exiled<br />
and abdicated out of their territories and dominions of holland Zeeland and [?XXX]<br />
deprived of all Priviledged and freedomes to their Subjects belonging<br />
by meanes whereof hee was necessitated to retreat into<br />
fflanders as aforesaid, at or about which time hee as admitted and<br />
received free Nurgher of Ostend as aforesaid, and thereby a<br />
Subject of the king of Spaine, and did and doeth enjoy all the<br />
franchises immunities and tuition to such a Burgher and Subject<br />
appertaining, The premisses this deponent knoweth upon the grounds<br />
predeposed, and for that this deponent hath in that condition for all<br />
time hold correspondence with, and done the businesse of the<br />
producent as his Agent, and hath beene with him in his house<br />
att Ostend. And otherwise cannot depose/
