Lading mentioned that the said tenne baggs of Goats wooll<br />
conteyned two thousand sixe hundred and eight Rotuloes neat weight<br />
and that according to the estimation and accompt of Merchants<br />
in deducing or ballancing the Smyrna Accompt with<br />
English according to weight an hundred Rotuloes of Smyrna is<br />
reputed, accompted and taken for and to bee one hundred<br />
twenty and five pounds weight English, The which this<br />
deponent hath very well observed and experimentally knowne<br />
in many computations concerning many severall parcells<br />
of goods come from Smyrna to this port of London,<br />
And he further deposeth and saith that according to the said weight<br />
there was wanting of this deponents knowledge (who was present<br />
at the taking up and weighing od the said wools here at<br />
London) about two hundred and eighty pound weight, And<br />
that every pound of the said wooll was better worth then 16 [?XX GUTTER]<br />
And further he cannot depose./
To the last he saith his former deposition is true./
To the Interrogatoryes in the first place ministred.
To the first Interrogatory he answereth that he commeth to be a wittnes<br />
in this cause by the order of Alderman Micoe this Rendents<br />
Master, and that he favoureth both oartyes alike as unto iustice<br />
and for his part he saith he would give the victory accordingly<br />
(that is) to that party that it shall appeare right is of<br />
his side.
To the second Interrogatory he answereth that this Rendent first saw the<br />
wools interrate at their Landing at the Customehouse, And further he<br />
cannot answeare.
To the third Interrogatory he answereth that the baggs wherein the<br />
woolls were, were at the time of their being putt ashoare at<br />
the Custome house, much torne and loose, of this Rendents<br />
knowledge being there present when they were Landed And<br />
further he cannot answeare./
To the Interrogatoryes in the 2d place/
To the first Interrogatory he answereth that he referreth himselfe<br />
to his former deposition made to the third and fourth articles<br />
of the allegation And further he cannot depose./
To the second and third Interrogatoryes he answereth that<br />
he was never at Smyrna, but he saith 'tis the use and<br />
custome here in England is that if package be broken and<br />
the losse therby considerable, then the Master of the<br />
shipp or vessell hath bin Lyable to make good the samage<br />
or want of weight, And he further answereth that<br />
the interrate and circumspect words The inside, quality<br />
and condition I knowe not, And further he cannot answeare
To the fourth he cannot answeare./
To the fifth Interrogatory he answereth that he this Rendent did see<br />
the said Goats wooll weighed presently after the Landing therof<br />
at the Custome house, and he saith that none of the said<br />
woolls were diminished between their Landing and weighing and<br />
that he knoweth not whither they were dimninished after<br />
they were unladen out of the ''Cesar'' but if they were it<br />
was done when they were under the charge of the said [?ffudge GUTTER]<br />
having one man or more in the Lighter that brought them<br />
ashoare, And further he cannot answeare./
