Owner of the said goods respectively the said persons were and are well<br />
knowne and commonly reputed and taken, Which hee this examinate well<br />
knoweth for the reasons in his subsequent depositions expressed And further<br />
cannot depose./
To the second hee saith, That in or about the moneths of June and July<br />
in the yeare <u>1654.</u> allate the said ffrancisco Lopez at Santa Cruz in<br />
the Island Teneriffe aforesaid caused the said one hundred and thirty halfe<br />
Chests of sugar and six hundred and twenty hides of the first marke<br />
before expressed to be laden in and aboard the said shipp the ''Santa Maria''<br />
''de Guarda Lupa'', whereof this deponent was Master and that for and upon the<br />
proper accompt and adventure of the said francsico Lopez, and saith That<br />
in or about the moneths aforesaid the said John Baptista de Pontey<br />
ffontey Papes at Guarachicho in Teneriffe caused the said six great<br />
ffatts of sugar of the second marke predeposed to be for his owne accompt<br />
laden and putt aboard the said shipp, And saith That in or about the<br />
moneths aforesaid tthe said Asensio daranga Maderos did at Guarachicha<br />
aforesaid for his owne proper accompt cause to be laden in and aboard the said<br />
shipp foure and fiftie hides marked with the third marke predeposed, All<br />
which goods were so laden and designed to be transported in the said shipp<br />
from the Teneriffe aforesaid, and there to be delivered to Balthazar and<br />
John Coymans Merchants of Amsterdam, their the said producents Agents<br />
and Correspondents there, for the said producents uses and respective accompts<br />
as aforesaid. The premisses hee well and perfectly knoweth as being Master of<br />
the said shipp the Voiage in question, and for that hee gave order for the receiving<br />
of the said goods aboard his said shipp, and upon ticketts sent from aboard by<br />
this deponents steeresman for the receipt of the same, hee this deponent signed<br />
bills of lading to the aforesaid prioprietors and entred the same in his shipps<br />
booke accordingly And further cannot depose/
To the third article hee saith, That after the lading of the said goods and<br />
Merchandizes in the said shipp shee departed and sett sayle therewith<br />
from the Teneriffe aforesaid bound for Amsterdam, and in her Course<br />
thitherwards was mett withall and taken by Peter Collaart inder pretence<br />
of a Commission from the king of ffrance, upon which surprizall the<br />
said Collart and Companie tooke out of the said shipp six and Twenty<br />
Chests of sugar or thereabouts, and between two and three hundred hydes,and<br />
about three hundred peeces of Campeche wood and some other small things,<br />
but did not take out anye ther of her lading so long as shee was in his<br />
possession, nor carried her under Commaund of any ffort or Castle in ffrance,<br />
neither were all the said shipps Companie taken out of her by the said<br />
Collart and Companie, but about five or 6. of the said shipps Companie<br />
remained and were aboard her at such time as shee was afterwards pursued and<br />
taken by the ''Saphire frigatt'' in the immediate service of this Commonwealth<br />
