To the Interrogatories [CENTRE HEADING]
To the first hee saith hee was masters mate of the shipp Interrogated the voyage<br />
Interrogated And further cannot answere./
To the second Interrogatorie hee saith hee well knoweth that while the open<br />
lighter Interrogated laye by the side of the shipp ''Smirna ffactor'' there came<br />
a cloase lighter to lade fine goods on board the sayd shipp and then ready to be<br />
delivered, but by whose order hee knoweth not nor hath heard And<br />
further hee cannot for his part answere otherwise then negatively not knowing<br />
nor having heard of any such order as is Interrogate./
To the third Interrogatorie hee answereth that when the cloase lyghter Interrogate<br />
came downe to the sayd shipp the open lighter laye by the side of the sayd<br />
shipp and had taken in some ladeing but how much sheehad then taken in hee<br />
remembreth not, and saith upon the arrivall of the sayd close lighter<br />
the sayd open lighter was put a little abafte but continued still by the sayd<br />
shipps side and the sayd cloase lighter lay alsoe on the same side of the shipp<br />
and further hee cannot answere saving his foregoeing deposition not now remembring whether any goods were<br />
laded into the open lighter after the arrivall of the cloase lighter or not nor<br />
whether the company of the sayd shipp did presently goe on to lade the sayd cloase<br />
lighter or not.
To the 4th saving his foregoeing deposition to the allegation and precedent Interrogatories<br />
hee answereth negatively./
To the 5th hee cannot answeare in regarde hee tooke noe notice of her the sayd<br />
open lighters strength or staunchnesse before the ladeing controverted was put into her<br />
it not being a thing usuall for the company of a shipp to take notice of<br />
the staunchnesse of the lighters, it being a care proper to the owners and mannagers<br />
of them./<br />

To the first article hee saith hee hath perused the booke<br />
of Statutes touching the matter in question, namely the Gage of<br />
sweete oiles, and findeth that there is a Statute made in the 18th<br />
yeare of henry the 6 [?XXX] .17. whereby it is enacted that every<br />
tonne of oule and honey should containe 252 gallons, and<br />
that whosoever should sell at a lesse measure should forfait the<br />
valew of the goods to the kinge, with<br />
other clauses mentioned in the said statute, to which hee this deponent<br />
referreth himselfe. And otherwise hee cannot depose.
To the fourth article hee saith there was 15th of July last<br />
