To the third and 4th articles of the sayd allegation and the schedule in the sayd<br />
third article mentioned hee saith That the sayd Peter Martin<br />
presently after the seizure of the sayd shipp ''Madam Guardiana''<br />
did acknowledge and confesse to this deponent that the sayd shipp<br />
''Mada, Guardiana'' was a ffrench shipp and belonged to Marcellia in<br />
ffrance and that the Owners of the sayd shipp, and all her ladeing (except<br />
betwixt two and three hundred dollers which was laded on board her for the<br />
Accompt of an English Merchant one of the Owners of the ''Affrican ffrigott''<br />
aforesayd) were ffrench men subiects of the Kinge of<br />
ffrance, and saith that hee this deponent did observe that the sayd Peter<br />
Martyne after his arrivall at Smirna was divers tymes at the English<br />
Consulls house and further hee cannot depose not being present at any<br />
acknowledgement made by him before the sayd Consull to the effect arlate<br />
nor seeing the schedule arlate signed or subscribed and further hee<br />
cannot depose

sworne and examined saith and deposeth as followeth videlicet./
To the first article of the said allegation he saith and deposeth that in the moneths<br />
and tyme arlate in the yeares 1653 and 1654 the arlate Isaac Woodgreene and<br />
Company had a Commission under the great seale of this high Court of<br />
Admiralty to man arme and set forth the ''Affrican ffrigot'' as a private man<br />
of warr to seize and surprize the shipps and goods of the ffrench king and his<br />
Subiects And saith the sayd Woodgreene and Company in persuance of the sayd<br />
designe did sett out and imploy the sayd ffrigott accordingly the premisses hee<br />
deposeth goeing purser of the sayd ''Affrican ffrigott'' the whole voyage in question<br />
and having often seene and read the sayd Commission And further hee<br />
cannot depose saving his subsequent deposition/
To the second article of the sayd allegation hee saith that the sayd Isaac<br />
