and an Inhabitant of Limma in the Indeies merchant aged 38 yeares<br />
or thereabouts a witnes sworne and examined deposeth and saith<br />
as followeth videlicet
To the 1. 2. 3. and 4th articles of the sayd allegation This deponent saith that in or about the<br />
moneth of August 1652. being att Cadiz in Spaine and in Company with and<br />
in the howse of William Porneliz the factor of the producent he then and there<br />
saw in his possession severall peaces of plate and sylver which he ths ayd Porneliz<br />
then sayd did belong to the arlate Symon da ffonseca Pyna of Madrid, and<br />
amongst the rest the barr of sylver arlate marked as in the margent<br />
and weighing 120 markes or thereabouts, which sayd parcells of silver<br />
the sayd Porneliz then sayd he had order to remitt to Juan Alvarez<br />
of Antwerpe for the producents accompt, and that he did intend to<br />
send the same accordingly by Otto George, Christian Cloppenbergh and<br />
John Martins whose ships then lay in the bay of Cadiz bound for<br />
Ostend. And further saith That not long after and within the sayd<br />
moneth of August 1652. This deponent being againe with the sayd<br />
Porneliz att his howse he told this deponent that he had laden the<br />
forementioned sayd parcells of sylver on board the sayd shipps, and withall shewed<br />
this deponent bills of lading for the same, one whereof was the bill of<br />
lading arlate and now shewne him or of the same tenor withal, By which<br />
bill of lading It did then appeare as now it doth to this deponent<br />
that the sayd Porneliz did about the 14th day of the sayd moneth of August <u>1652</u><br />
lade the forementioned barr of sylver marked as aforesayd on board the<br />
arlate shipp the ''Salvador'' whereof Christian Cloppenbergh aforesayd<br />
was master for the accompt of the sayd Symon da ffonseca Pyna to be<br />
transported to Ostend and there delivered to the arlate Juan Alvarez<br />
and in his absence to the widdow and heyres of Simon Dias Vaez, or<br />
their factor. And moreover saith that the sayd bill of lading now shewne<br />
to and perused by him was and is as he assuredly beleiveth signed by<br />
the sayd Christian Cloppenbergh with the manner of whose firming<br />
this deponent having seene him firme to many bills of lading is<br />
well acquainted, and forasmuch it is usuall to firme 3 bills of lading<br />
of one and the same tenor for every parcell he beleiveth that the sayd Christian<br />
Cloppenbergh did firme to two other bills of lading of the same<br />
tenor for this barr of sylver now Claymed, and that one of them<br />
came along in the sayd shipp with the sylver, And saith that for the reasons aforesayd<br />
he is well assured that the Contents of the sayd bill of lading now given him<br />
were and are true and so had and done as in the same is [?feyned], And<br />
