Examined upon the foresaid allegation.

'''Hence Meimers''' of Hamborough Mariner aged 43 yeares or<br />
thereabouts, sworne and examined.
To the first second and third articles of the said allegation hee saith and deposeth that<br />
about five yeares since hee this deponent upon the exchange in hamborough<br />
was present with Daniel Brandes, John [?Novius]. Adolph Sumpton and<br />
Baselius van Borstell and Claus Colbrand (nowe master of the ''Partriarch''<br />
''Jacob'' arlate) and heard them conferring together about a shipp the<br />
said persons, Brands, [?Novis], Sumpton and Van Borstell had ordered the said<br />
skipper to build for their accompt in holland and about the chardge and cost thereof,<br />
and heard them say that the cost should be about 10000 gilders for the hull,<br />
and soe much the said skipper Claus Colbrand said was demannded by a<br />
master builder, and the said persons then and there gave the said Claus order<br />
to proceede in the building and buying the said shipp for their accompt who<br />
thereupon departed for holland, and as this deponent hath often heard<br />
caused the said shipp to be built and named her the ''Patriarch Jacob'' and<br />
tooke the commannd of her to the use of the said merchants, who have<br />
ever since bin accompted her owners, and the said shipp hath ever since<br />
bin commonly accompted and said to be a hamburger shipp, and to be<br />
belonging to hamborough, And otherwise hee cannot depose, saving that<br />
the said Claus Colbrand is master of the said shipp at present, which hee<br />
knoweth because hee came from Cadiz this voyage in her company.

To the 6 and 7. hee saith that in July last past and shortly before this deponents<br />
departure from hamborough for Cadiz with his shipp the ''Crowne''<br />
''Imperiall'' the wife of the said Claus Colbrand meeting with this deponent at<br />
hamborough, said, Neighbour, I would I had sooner had notice of your<br />
being freighted for Cadiz, for then I would by you have sent the [?fXXXXX]<br />
and provisions to my husband (speaking of the said Claus) for his shipp<br />
the ''Patriarch Jacob'' for Cales, which I have nowe laden in hanse Schoonback<br />
who is thither alsoe bound, and as hee heard, the said<br />
Schooback in his passage for Cadiz was taken by ffrench sea Rovers, and<br />
soe the said goods lost. And otherwise hee cannot depose.
To the 8 hee saith that the said Daniel Brands and the rest of the foresaid<br />
owners, have and doe from time to time take upon them to be and are<br />
by merchants and others at Hamborough commonly looked upon and<br />
reputed as owners of teh said shipp, And otherwise hee cannot depose.
To the 9 10. and 11 hee saith the said shipp the ''Patriarch Jacob'' lay this summer<br />
three monethes and upwards in the bay of Cadiz neere this deponents said<br />
shipp, and all that space of this deponents sight and knowledge wore<br />
the Hamburger colours and noe others, and it was commonly said that<br />
shee came thither from haver de Grace, And otherwise hee cannot depose.
To the 12 hee cannot depose
To the 13 hee saith hee hath knowne all the said persons arlate from<br />
his youth to be living in Hamborough, where they were and are subiects<br />
and Burghers, and for such commonly accompted.
