aged 21 yeares or thereabouts a witness sworne<br />
and examined deposeth and saith as followeth videlicet
[XXX] Mender [XXX]
To the 1. 2. 3. and 4. Articles of the sayd allegacion and bill of lading<br />
there annexed This deponent saith that being upon the bay of Cadiz<br />
about merchandizing affaires in or about the beginning of October<br />
1652 he then and there saw a boat or barke with the wooll now claymed<br />
therein lyeing by the side of the articulate shipp the ''Salvador Christian''<br />
Cloppenbergh Master in the possession of a youngman a Spaniard<br />
the factor of the [prodment?] who was then a lading the same and upon<br />
occasion of discourse touching the same di then say and declare that<br />
the sayd woools being marked as in the [margent?] and in the whole<br />
11 sackes 4 of washed wooll and 7 of Lambes wooll, were the proper gods<br />
of the sayd Blaes de La Pyna a Neighbor of this deponent in Sevilia<br />
and that he did lade the same upon the sayd Pynaes accompt to be in<br />
the sayd shipp transported to Ossend, and that he would and did consigne<br />
the same to Antonio Lopez Swaso or his Assignes for accompt and use of<br />
the sayd La Pyna. And saith that some few dayes after he this deponent<br />
being in Company with the sayd factor att Cadiz saw in his hands two bills<br />
of lading for the sayd woolls both of one tenor purporting to be signed<br />
by the hand and with the name of the sayd Christian Cloppenberg<br />
which the premises did likewise plainly appeare to be true, one of<br />
which bills of lading he then told this deponent he was to send in<br />
a letter of advise by post to the sayd Swaco att Antwerpe. And saith<br />
that the bill of lading to the sad allegation annexed now shwen him was and is one of the<br />
Originall bills of lading for the sayd woolls, and the Contents thereof<br />
were and are true and reall, and he beleiveth the same to be the very<br />
bill of lading designed to be sent from Cadiz to Antwerpe as foresaid<br />
and that it was sent from Antwerpe to the Citty by the sayd Swaco. And<br />
he further beleiveth it to be true that according to Custome there was<br />
another or third bill of lading of the same tenor for the sayd woolls,<br />
signed together with the rest and left with the sayd Cloppenbergh to come<br />
along with the said woolls, which was as he beleiveth aboard att the tyme<br />
of seizure, and further referring himselfe to the Acts of this Court and<br />
the Registry thereof where the said bill of lading is sayd to be he cannot<br />
depose.
To the 5. 6. 7 and 8 articles of the sayd allegation This deponent saith that the<br />
