London Marriner aged 30 yeares or thereabouts sworne and Examined
To the first article of the said Allegation hee referreth himselfe to the [?order] of the right<br />
honorable the Councell of State and to the Registrie of this Court arlate And further hee<br />
cannot depose save only that of the deponents knowledge the producent Thomas<br />
Awres and company did sett forth the ship the ''Harry'' arlate upon this her last voyage and<br />
designe to Nor Berghen. In which this deponent was one of the Quarter masters of the said<br />
shippe. And other wise hee cannot depose
To the second article of the said Allegation hee saith and deposeth That dureing such tyme as<br />
the producent Thomas Awres was and remayned with the ship the ''Harry'' arlate in the<br />
Port of Nor=Berghen in Norway which was in the moneth of July last past<br />
the ship the ''Arke of Noah'' arlate was then in that harbor allsoe<br />
takeing and receaveing in the horses or mares abord her which by the said<br />
producent and company were afterwards taken in her And saith that upon<br />
the six and twentieth day of the said moneth of July this deponent together with<br />
his precontest and Contest William [?Carrell] and others of the said ship the ''Harryes''<br />
Companye being a shore in the Towne of Nor Berghen at a drinking house kept<br />
there by a Scotchman hee and they did then and there heare the arlate Andrew Hayer<br />
[?Merchantr] of the said ship the ''Arke of Noah'' say and affirme that hee had laden the<br />
said horses abord the said ship for the use of the King of Scotland and that<br />
the same were to be transported in the said shippe from thence to Abderdeene<br />
or Dundee in Scotland which Townes were then in Actualle Armes and Hostilitye against<br />
the Parliament of England. The said Merchant then apprehending and supposeing the said<br />
ship the''Harry'' to bee a Scotts Man of warre because shee had and wore the King<br />
of Scotts Colours whilest shee remained in that Harbor And [?soe]<br />
[XXX] hee saith was allsoe reportedby others who dwelt in the said Towne of Nor berghen<br />
which had advise to what port the said ship the ''Arke of Noah'' was bound with the said Horses<br />
And otherwise hee cannot depose.
To the third and fourth articles of the said Allegation hee saith and deposeth that at such tyme<br />
as the said shippe the ''Arke of Noah'' was seized and surprized by the ''Harry'' which was<br />
upon [XXXXth] day of July last past The said Andrew Hay[?or] still supposeing<br />
the ''Harry'' to bee one of the King of Scotts men of Warre at such tyme as hee came<br />
abord her hee did and [XXXX XXXX and XXXXing] againe saye and affirme that the said ship was bound to<br />
discharge the said horses abord her at Dundee or Abderde[?e]ne in Scotland for<br />
the use of the King of Scotland and did then and there proffer to give the<br />
said Thomas Awres a hundred dollers to convoy him to either of the said places<br />
And saith that at the said tyme of the seizure of the said ship the ''Arke of Noah''<br />
she was in her direct Course for Scotland and quite out of the way for Holsten which hee<br />
knoweth because that at the said tyme the winde blewe att [XXX XXXXX] and the<br />
said ship sailed west nor-west when as if she she had bin bound for Holsten her<br />
direct course was South or by South=South East. this deponent well knoweing th[?o]se<br />
parts and coasts. And otherwise hee cannot depose.
To the 5 and 6th articles hee saith and deposeth That ymediatly after the seizure and<br />
Surprizall of the said ship the ''Arke of Noah'' and the horses abord her The producent<br />
Thomas Awres did in this deponents presence and heareing demand of the said<br />
Andrew H[?ayar] the [XXXX] and the Skipper of the said ship where theire cocquetts<br />
and papers were for the said lading to whom they againe replyed that they had<br />
none, nor did they [?neede] any, [XX] said [XXXX] Adding further that hee had the klast<br />
S[?u]mmer made two severall voyages before this with horses for the Kinge of Scotts over<br />
to Scotland and that hee had noe papers cocquetts or bills of loading abord<br />
in either of the said voyages. And otherwise hee cannot depose.
To the 7 and 8th hee saith hee cannot depose
