aged 23 yeares or thereabouts sworne and [BLANK IN MANUSCRIPT]
To the first and second articles of the said allegation and schedules ammexed hee saith and deposeth hee well<br />
knoweth the producents Hojah Jacomo and Hojah kamal Armenian Merchants, and<br />
saith they have vin for the time arlate and are the true and lawfull owners and<br />
proprietors of the goods and marchandizes mentioned and expressed in the said<br />
two schedules and soe commonly accompted, videlicet the said hoggia Jacomo of<br />
those mentioned in the first of the said bills of lading and the said hoggia kamal<br />
of those in the second, and saith that within the said time videlicet about six monethes since the said producents<br />
laded the said marchandizes at Smirna aboard the shipp the ''Saint Martin'' arlate<br />
for their owne accompt to be thence carried and transported in the said vessell for<br />
Ligorn[?a] and their delivered to them or their use, which hee knoweth because hee<br />
this deponent was at Smirna and sawe them soe lade the said goods for their<br />
owne accompt, And otherwise hee cannot depose saving what followeth.
To the third article and schedul[?a]s aforesaid hee saith and deposeth that the said<br />
schedula[?a]s were and are the true and originall bills of lading for the said<br />
respective goods therein contained, and were and are signed and subscribed<br />
by and with the proper hand of Michael Audric Captaine of the said<br />
shipp the ''Saint Martin'', which hee knoweth because hee this examinate was<br />
present in the house of one Monsieur dannian a merchant living in<br />
Smyrna and sawe the said Captaine there signe the said bills, the contents<br />
whereof hee saith were and are true and soe had and donne as therein<br />
is contayned. And otherwise hee cannot depose.
To the fourth article hee saith and deposeth that after the said producents had soe<br />
laded the said goods aboard the said shipp they alsoe imbarked themselves in<br />
the same to goe along with and dispose of their said goods, and the<br />
said shipp (within the said time) departed from Smirna and [Xent]<br />
her course directly for Ligorna, in which her course shee and her lading<br />
were met with surprized and taken by a Squadron of eight English<br />
shipps in the service of the Parliament, at which time the said producents<br />
were aboard and were alsoe taken in her, and had them about them and<br />
in their possession their said respective bills of lading which they brought<br />
with them from Smirna, all which hee knoweth being acquainted with<br />
such their bringing their said bills of lading alonge with them from Smirna<br />
and being alsoe aboard when the said shipp and goods were soe seized, And<br />
otherwise hee cannot depose.
To the fifth article hee saith and deposeth that the said producents<br />
were and are Armenian Marchants and doe usually trade from Persia<br />
to Smirna and from other parts, and doe usually [?commerce] with the English<br />
in those countries, with whom they maintaine faire correspondence, and<br />
saith the said Jacomo was and is a subiect of the kinge of Persia and<br />
the said kamal of the grand Seignor, betwixt which Princes and<br />
Nation there was and is peace and amitie, and for such they were<br />
and are commonly accompted. And otherwise hee cannot depose.
To the last hee saith that his foregoeing deposition was {and} is true.
To the Interrogatories [CENTRE HEADING]
To the first hee saith that hee this examinate was only a passenger<br />
in the said shipp the ''Saint Martin'' when shee was seized as aforesaid and<br />
came first aboard her at Smirna aforesaid, which was the time predeposed<br />
after the lading of the said goods.
To the second Interrogatorie hee saith and deposeth that the said Haiah Jacomo<br />
whom hee saith hee hath knowne five or six yeares and upwards, was<br />
and is of Spaham afore said and a subiect of the kinge of Persia the said<br />
kamal , whom hee saith hee hath knowne about foure yeares was and is of<br />
Bursia in the dominions of the Grand Seignior, in which severall cities the said<br />
persons were as hee hath heard borne, and saith that hee this deponent<br />
is alsoe an Inhabitant of Spaham, and to the rest of the said<br />
Interrogatoria hee answereth negatively, saying that they nor any of them belong<br />
to any ffrench factoria, nor have any relation to the ffrench or the kinge of<br />
