sworne and examined as aforesayd sayeth and deposeth uppon his oath as<br />
followeth videlicet
That the schedule nowe delivered by him into the Registrye<br />
of this Court is an extracte taken out of the records remayninge<br />
in the towne house of Middleborough, and is subscribed with the proper hande<br />
writinge of Thomas Morris notarye publique dwellinge in Middleborowe<br />
and doth agree with the records remayninge in the said towne, which he knoweth<br />
to be true for that he this deponent in the moneth of November 1633 beinge<br />
in Middleborowe, to seeke restitution of cetayne sugars belonginge to him<br />
and George Henlye of London merchant, then latelye broughte to fflushinge<br />
in a shipp called the Pellican of London whereof John Dowish was master,<br />
did cause the examinations expressed in the sayd schedule to be taken<br />
before the magistrates of the sayd towne or cittye of Middleborowe in<br />
the presence of the sayd Morris, and one Thomas Micklefield admitted and sworne<br />
as Interpreters in that behalfe and shortly after the takinge of the sayd<br />
examinations this deponent desired a copie of them, and thereuppon the schedule<br />
aforesayd was written out of the sayd records, and this deponent did see the same<br />
examined and helped to examine the same with the originall examinations remayninge uppon record in the<br />
sayd towne or cittye of Middleborowe, and thereby found that it did agree with<br />
the English translation remayninge uppomn record in the sayd towne, and in testimonye<br />
of the trueth thereof sawe the said Thomas Morris subscribe his name thereunto<br />
and sawe the seale remayning uppon it, sett uppon it in the sayd towne house of<br />
Middleborowe, alsoe this deponent sayeth that he this deponent<br />
did resde in Holland and Zealand in seakinge restitution of the sugars<br />
aforesayd belonginge to this deponent and the sayd Mr Henlye by the space of fower<br />
monethes or therabouts and sent over and imployed divers other agents there in that behalfe<br />
and this deponent and the sayd Mr Henlye did really and necessarily disburse in prosequetinge<br />
of lawe and seeking restitution of the sayd goods the somme of five hundred fiftye<br />
eight pounds of lawfull money of England. And this he affirmeth uppon his<br />
oath to be true./
