To the first and second Interrogatoryes he sayeth That the shipp the ''Rebecca''<br />

To the third he sayeth That the sayd ffrancis drake when the sayd<br />
shipp was at Virginia the voyage aforesayd was by the report of<br />
the Chirurgeon and the generall opinion of the company of the sayd shippe<br />
sicke of a drye scurvey Et alr nescit deponere./
To the fourth he sayeth that the sayd ffrants drake whilest the sayd shipp<br />
was at Virginia the voyage aforesayd, beinge much distempered with drincke<br />
came into the sayd shipps boate to goe abord, and the sayd Peter Rexford<br />
beinge in the sayd boate, and havinge commannde of all the company in the<br />
masters absence, commannded the sayd drake to hoyste up the sayle of the sayd<br />
boate, and uppon some words which past betweene the sayd Rexford and<br />
and drake, they were strivinge and buslinge togeither and the sayd drake<br />
standinge uppon some hogsheads of Tobaccoe in the same boate<br />
had gott the sayd Rexfords head under his arme, and then Andrew<br />
Johnson the gunner of the sayd shipp stopt to them and parted them,<br />
and in the partinge of them, one of the sayd drakes leggs slipt in betweene<br />
two hogsheads of Tobaccoe and the rest of his bodye fell backwards, and<br />
presently theruppon the sayd drake cryed out that his thighe was broken<br />
but this deponent who was one of them that rowed the sayd boate at that tyme<br />
and others did not beleive the same, but supposed that the sayd Drake because<br />
he was soe distempered with drincke did not knowe what he sayd, but it<br />
proved true which he sayd, and afterwards the Chirurgeon of the sayd shipp with<br />
the helpe of a Chirurgeon of another shipp did sett his thigh agayne<br />
and this deponent beinge then present did heare when the bones of his thigh went<br />
in to their place agayne, and did see the Chirurgeon putt and binde<br />
splints about his thighe and tould the sayd drake that he must lye still twenty<br />
foure dayes before the sayd splints should be taken off, but the sayd splints<br />
were taken off and lyeinge betweene the sayd draks chest and his bedd<br />
within fourteene or fifteene dayes after he receaved the sayd hurt, contrarye<br />
to the sayd Chirurgeons directions, and afterwards his thigh grewe worse<br />
and worse, and much putrifyed, and the master of the sayd shipp and likewise<br />
the Chirurgeon would have had the sayd drake caryed on shoare where he<br />
mighte have fresh victualls, but the sayd drake would nnot yeild therunto, but was<br />
addicted to drinckinge of stronge waters, whilest he was under the Chirurgeons<br />
hands, and dyed in the sayd shipp homewards bound, and he beleiveth that the sayd Rexfor<br />
was absolutely cleere and guiltlesse of his death, and that the sayd drake would have<br />
bene a livinge man at this tyme if he would have followed the masters and Chirurgeons<br />
directions And further he cannot depose/
