for James C[?ade] William Billing<br />
ffrancis Bond and Company and made<br />
himselfe partie for them and alleadged that<br />
the said vessell the ''Endeavour'' did at the time of<br />
the arrest thereof in this behalfe made and still doe<br />
belonge unto them and that shee is laden at the Isle<br />
of Wight with goods to a very great value and bound<br />
to this Porte of London and that by reason of the said<br />
arrest the said vessell is hindred from proceeding upon<br />
her voyage to the great losse and dammage of the<br />
owners of the said vessell and ladinge Whereafore for<br />
the prevention of any further dammage by reason of<br />
the said arrest and to the end the said shippe may<br />
proceed upon her intended voayge to that porte of<br />
London the said Cheeke offered sufficient security to<br />
bringe the said vessell from the Isle of Wight to the<br />
porte of London and to submitt her to the arrest of<br />
the Court under which shee nowe is within a moneth or to<br />
pay the value thereof accordinge to an appraisement<br />
thereof to bee taken by authority of this Court in case<br />
shee shall perish or miscarry in the meane time to the<br />
said Browne or for such parte thereof as shall bee by<br />
this Court adjudged to the said Browne Which Caution hhe<br />
the said Cheeke prayed to bee receaved and a Comission to bee<br />
decreed for the appraisement of the said Vessell and the<br />
said appraisement being taken the said vessell to bee decreed to<br />
bee released from the said arrest in the presence of the said<br />
Smith appealing for the said William Browne and makinge<br />
himselfe partie for him not opposing the same Whereupon<br />
the Hudges did decree the said baile to bee receaved in<br />
such manner as is desired and the said shippe to bee<br />
appraised by Commissioners to bee named on both sides and the<br />
said appraisement being taken the said shipp to bee<br />
released from the said Arrest, Aftrerwards the same day<br />
before Doctor Godolphin in his Chamber et cetera in the<br />
