Which day Mr Gold gave in his answeares to the libell<br />
given against him on the behalfe of the said hill<br />
hallott and others which he acknowledged to be true in<br />
the presence of the said Smith alleadging that it is not<br />
answeared to the articles of the libell (except to the first)<br />
referring himselfe et cetera and desired a fuller answeare to the same<br />
in the presence of ffrancklin dissentinge et cetera and alleadged that it is<br />
fully answeared referring et cetera whereupon the Judges assigned to<br />
heare the'order of the Court upon the petition of the said Smith upon<br />
Thurdsday next.

to answeare the action commenced by the said<br />
Crandley Bayly and company against the said shippe<br />
the ''Mayflower'' and alsoe against the said White and to<br />
pay what the said White shalbe condemned in with<br />
expences of suite in case he shalbe overthrowne and to<br />
bring forth the said White in Judgement whensoever his<br />
presence shalbe required And the said White obliged himselfe<br />
et cetera in the same summe and to the same effect and to save his<br />
said dureties harmeles And unes et ctera which caution the Judges<br />
receaved and decreed the said shipp and White to be released from<br />
the arrest./.

shipp did att the time of the arrest in<br />
this behalfe made and still doe properly<br />
belonge and appertayne unto the said Terricke<br />
and company and produced for sureties hugh<br />
Wood of the said parish of Saint Alban Woodstreet<br />
London merchant and henry Spurstowe of the<br />
parish of Saint hellens London merchant and George<br />
Smith of Saint Bartholomews Exchange merchant whoe all<br />
of them submitting themselves et cetera obliged themselves et cetera for<br />
the said Nicholas Terricke and company in the summe of 300 ''li''<br />
of lawfull money of England to the said George Margetts<br />
to answeare the action commened by him against the said 11.16<br />
parts of the said shipp soe farre as the same are lyable by<br />
lawe and to pay what the said Terricke and company<br />
shalbe condemned in with expences of suite in case he shalbe<br />
overthrowne and to bring forth the said parties in Judgement<br />
whensoever their presence shalbe required And unles et cetera which<br />
caution the Judges receaved and decreed the said parts to be released<br />
