Which day the said Budd as<br />
proctor for the said Captaine<br />
Lawson and Captaine Howett<br />
and Company to all intent<br />
and effect of Lawe that doth or<br />
may any way follow thereupon<br />
did propound and alleadge that<br />
in the monthes of June July<br />
August and September in the yeare of our Lord god 1654 and<br />
for divers yeares or monethes<br />
next before and continually since<br />
the said Captaine Lawson and<br />
Captaine Howett and Company<br />
were the true and lawfull owners<br />
and proprietors of a certaine<br />
shipp or vessell amed the<br />
''Providence'' of Scarborough and<br />
of her tackle apparrell and<br />
ffurniture and of a quantity of<br />
Newcastle Coales and other<br />
goods wares merchandizes or<br />
provisions laden and put aboard<br />
the said ship and that they<br />
furnished the said shippe to<br />
Sea laden with the said<br />
goods for their account to bee<br />
carryed to Portugall and that<br />
in the said shipps course thither<br />
ward within the time aforesaid<br />
and more especially on or about<br />
the 28th of August 1654 shee<br />
was mett with and sett on<br />
by a certaine shipp named the<br />
''Michael'' of Brest wherein<br />
were the said James Smith<br />
and Albert Myler and divers others<br />
and that the said shipp did then belonge<br />
to the said Griffin and Company and that<br />
that the said Albert Myler and James Smith and<br />
other their Associates and Complices did in an<br />
hiostile manner being in the said shipp the ''Michael''<br />
of Brest by force and violence and without any<br />
lawfull warrant or Commission and against the goods will<br />
and liking of the said John Drake the Master and others<br />
the Company of the said shipp the ''Providence'' seize and<br />
surprize and take into their possession the said shippe<br />
the ''Providence'' and her Tackle apparell and<br />
ffurniture and all the Coales and other goods<br />
wares and merchandizes and provisions that<br />
were aboard her and utterly deprives the said<br />
