Evert Everson master of<br />
the said shipp the ''Charity''<br />
in whose presence the said<br />
ffrancklin to all effect in Lawe<br />
alleadged That the said William<br />
Murford was and is lawfull owner and<br />
Proprietor of one fourth part of the said<br />
Shipp and her Tackle and furniture, and for<br />
such commonly accompted, and that he ws and is in the<br />
true reall and actuall possession thereof, and that<br />
the said James Lynam was and is the lawfull owner<br />
and Proprietor of one other fourth part of the said<br />
shipp and her Tackle and furniture, and for such<br />
commonly accompted and in the true reall and actuall<br />
possession thereof, and that the said Mathias Molins<br />
was and is the true and lawfull owner of one other<br />
fourth part of the said shipp the ''Charitye'' and of her<br />
Tackle and furniture, and for such commonly accompted<br />
and in the true actuall and reall possession thereof<br />
And that the said Evert Everson was appointed master of<br />
the said shippe by the said Murford Lynam and Molins<br />
and putt master into the said shipp for them and to their<br />
use which allegation the said ffrancklin proposed ioyntly<br />
and severally and prayed the same to be admittedm and<br />
the Judges at his petition admitted the same, which being<br />
admitted and repeated and the said Everson not beleeving<br />
the same, the said ffrancklin produced upon the same<br />
the said Evert Everson a party principall to whome the Judges<br />
administred an oath to make his answer thereunto<br />
upon his oath wh[?oe] upon his oath did iudicially confesse that the said William<br />
Murford James Lynam and Mathias Molins were and<br />
are the severall and respective lawfull owners of the<br />
severall and respective 4 parts of the said shippe and<br />
her tackle and furniture videlicet in all of three 4th parts<br />
of the said shipp and her tackle and furniture and that<br />
they were and are severally in the true reall and actuall<br />
possession of the same three severall 4th parts<br />
of the said shipp and of her tackle and furniture<br />
and that he the said Evert Everson was appointed master<br />
of the said shippe by the said Murford Lynam and Molins<br />
and that he is in possession of three 4th parts of the<br />
said shippe to be master onely to and for the use of the<br />
said Murford Lynam and Molins which confession the<br />
said ffrancklin accepted and the Judges at ffrancklins<br />
petition deceased the said Murford Lynam and Molins<br />
to be defended and continued in the possession of the<br />
said three severall fourth parts of the said<br />
shipp and her Tackle and furniture.//>
