formerly called the ''Peter'' incase the same shalbe adjudged by this Court to<br />
the said executor and administrators aforesaid or the value of the said shipp<br />
according to the appraisement thereof to be taken by authority of this Court<br />
and to pay such expences of suite as the said Burton shalbe condemned in<br />

Which day appeared Mr Smith for the<br />
said Thomas Broadgate and made<br />
himselfe party for him and alleadged that<br />
14 tunns and a quarter of a tun of oyle<br />
brought to this port of London in the said<br />
shipp the ''hart ffriggott'' and in this<br />
behalfe arrested did at the time of the<br />
arrest in this behalfe made and still doe<br />
belonge unto the said Thomas Broadgate<br />
and the same were consigned unto him by bill<br />
of ladinge and that he is in the possession thereof<br />
and offered to give security to answeare any action his<br />
said Excellency the Lord Ambassador hath against the<br />
said Oyles whereupon the Judges did decree the said oyles<br />
to be released from the arrest he the said Broadgate first<br />
givinge security in this Court to restore the said 14 tunnes and<br />
a quarter of a tunne of oyle if the same be extant or els to<br />
pay the value of the same according to the appraisement thereof<br />
to be taken by authority of this Court in case the same shalbe<br />
adjudged to the said Lord Ambassador and to pay the expences of suite<br />
in case the said Broadgate shalbe overthrowne Then the said Smith<br />
produced for sureties Richard hambden of the parish of Saint<br />
Gregories London draper and John B[?recoon] of the parish of Saint<br />
Nicholas Coleabby London merchant who submitting themselves et cetera<br />
obliged themselves et cetera for the said Thomas Broadgate in the summe of<br />
1000 ''li'' of lawfull money of England to his Excellency don John Rodrigues<br />
de Saa Manezooz Lord Ambassador for the king of Portugall to the<br />
effect before expressed And unles et cetera Which caustion the Judges receaved<br />
and did decree a Comission for the appointment of the said Oyles to Comissioners<br />
to be named on both sides in case the said Suckley shall name by to<br />
morrow noone./.
