consent of the said ffrancklin and Suckley in regard the said shippe is laden did<br />
decree the said shipp to be released from the said arrest security<br />
being first given by the said Nicholson to pay the freight which shall<br />
grow due for the same to whom this Court shall adjudge the same and<br />
to abide the Judgement of this Court aswell in the possession in<br />
case this Court shall upon a summary hearinge find cause to<br />
adjudge the possession thereof to the said Sherwell as alsoe in the<br />
petitory and to pay what the said Nicholson shalbe condemned in<br />
with expences of suite in case he shalbe overthrowne Then the<br />
said Suckley produced for sureties John Poole of Saint<br />
Gregories London vintner and Roger Coniers of the parrish of Saint<br />
Andrew Wardrobe London vintner who submitting themselves et cetera<br />
obliged themselves et cetera for the said Sampson Nicholson in the summe<br />
of 500 ''li'' of lawfull money of England to the said Thomas Sherwill<br />
to the effect before expressed And unles et cetera./.

Which day the said Suckley appeared for<br />
the said Lord Oxinsterne and others<br />
and made himselfe party for them and Smith<br />
for the said Chelston in whose presence the said<br />
Suckley gave a libell in writinge which the Judges<br />
at his petition admitted soe farre as the same is by<br />
law admissible which being soe admitted and repeated<br />
and the said Smith not beleeving the same to be true the<br />
Judges assigned the said Suckley to prove the same the<br />
third Court day from hence and decreed for the party<br />
principall the third day after if et cetera Then the said Suckley upon<br />
the said libell produced for witnesses John derrickson and hance<br />
Johnson whom the Judges receaved and administred an oath into<br />
them to speake the truth at the time of their examination in the<br />
presence of the said Smith dissentinge and having the usuall time fore<br />
Interrogatories./.
