the said ship to Hastings and thence send the said ship to Rye whether they carryed<br />
this deponent overland, and saith, that at Hastings and Rye the Captaine<br />
tooke some wine out of the said ship, and kept the said ship at Hastings<br />
but one night but at Rye above three weekes, and saith that<br />
about ffifty hogsheads of wine and about ten peices of Brandy were<br />
taken away or leaked out which Leakage happened by meanes that the seizure<br />
kept the said ship soe long at Rye in soe hott weather, And saith<br />
that at Rye the Caper forced him and the passengers<br />
to give bond to one<br />
ffaccoone the Owner of the Caper for a hundred pound, to the<br />
end to get the said ship discharged but did not otherwise force them and saith that hee hath did not doe nothing<br />
to pay same said ship and Lading being free and noe reason therefore that hee<br />
should pay any thing and saith that thee said passengers and this deponent<br />
signed and sealed the sayd bond [?XXX] ffalcoone and thee Lieutenants<br />
the Captaine and another man was then present,<br />

Ad 10um rendet That if hee had bin met with by the ffrench Dutch or Danes<br />
hee would have sayd that hee had bin bound for Ostend, and soe his papers<br />
mentioned and hee would then have pretended that his papers onboard<br />
were reall, and if hee had bin brought upon his oath hee would have<br />
referred himselfe to his papers and would not have declared that hee was<br />
bound to London, and saith that his papers were made for Ostend for<br />
the reasons aforesd, et alr nescit, saving that the Captaine that took<br />
him shewed him noe Commission./
