Doctor of lawes surrogate to the Right Worshipfull Leoline Jenkins doctor of lawes Judge<br />
of the High Court of Admiralty of England say and deposeth by vertue of their<br />
oathes as followeth videlicet.
That off of the River of Emms upon the Coast of Holland they with<br />
their said ffrigott William Godfrey Commander about Wednesday last was a ffortnight discovered and gave chase<br />
to two hoyes and making up to them fired two Gunns<br />
to one of them named the ''Orange'', upon which she struck, and the other of them seeing now<br />
opportunity of an Escape, bore up to the ffrigott and struck also And when these<br />
deponents came up with them they went aboard and tooke possession<br />
of them and found them both to bee laden with oake Timber<br />
for shipping. And imediately after such taking the Commander<br />
of the ''Crowne ffrigott'' sent and ordered these deponents to goe on<br />
board and bring the said Hoyes up the said River of Thames<br />
namely these deponents Andrew Barton John Ennett, John<br />
Carter on board (the ''Death''), and constituted this deponent<br />
Andrew Barton as Commander of her, And these three deponents say<br />
and declare that two Dutch men that were left aboard<br />
(the Skipper being taken onboard the Crowne) declared that<br />
the said lading of Oake Timber was lawfull prize and that they were and<br />
bound for Holland and soe they constantly<br />
affirmed during the time these deponents were aboard the said Hoy<br />
And they further say that off of Yarmouth a ffrench<br />
ffisherman gave chace to the said prize (the ''death'') who comming<br />
and bearing up with them the said two Dutchmen told the<br />
ffrenchman that there were goods onboard their said Vessell were<br />
Hollands goods and that they were bound for Holland, where<br />
upon the ffrench asking the said Dutch men if they would bee<br />
released the said Dutch men answred that they would. then the<br />
ffrench men bad them to come on board. Whereupon one of<br />
the Dutch men being at the Helme endeavoured thereby to lay<br />
the ffrench man aboard which this deponent taking notice of<br />
thrust him from it and fired a pistoll at them and soe gott cleare.<br />
And saith that this deponents John Rice and Thomas [?Chick], and Henry Bryan since [?XXX] was put aboard the ''Orange''<br />
The other prize and put this deponent John Rice Master of her And<br />
one ffleming that was left in the ''Orange'' (the Master and the other<br />
of them being taken aboard the ffrigott.) often declared to this<br />
these two deponents John Rice and Thomas Chick that the said lading of<br />
oake timber aboard the said prize the ''Orange'' was free prize, belonging<br />
to enemys of this Crowne. And saith they came to an anchor with them<br />
said two prizes at Saint Catharines where they came yesterday afternoone<br />
the afternoone where they are now remaining
