Ad primum arlum nescit deponere./ Ad 2um et 3um arlum dicit that the arlate Captaine John Poines<br /> and Company with the ffrigot the ''Wakefeild'' did off of deepe at or about the month of Aprill or<br /> May 1659 rescue and retake, a ship laden with Rye from<br /> an Ostend man of warr, which was<br /> Carrying of her for Ostend as a Prize which hee knwoeth<br /> being then one of the said Captaine Poines his Company and<br /> assisting in the said rescue. Ad 3um et 4um dicit, that after the said Rescue the said Captaine<br /> Poines this deponent and Company carried the said rescued<br /> vessell to Deepe Roade, where hee saith the said Poines<br /> tooke out a quantity of Rye (as hee confessed to this deponent<br /> and severall of his Company,) and disposed thereof,<br /> And saith that this deponent being then in the said ''Wakefeild<br /> ffrigott'', sawe a sloope copme from deepe to the side of<br /> the said rescued ship, empty, and after it<br /> had bin there about two houres hee sawe the same<br /> goe Loaden from the said rescued ship, to Deepe and<br /> hee verily beleeveth the said sloope was loaden with<br /> Rye, and from thence the said Captaine Poines and<br /> Companie carried the said rescued ship to the Downes<br /> where some of the said ffrigotts Company muttering, and<br /> seemming somewhat discontented that the said Captaine<br /> Poines should take out soe much rye and that they<br /> should have nothing, the said Poines told them in this<br /> deponents hearing, that hee had taken something for himselfe<br /> and that if they had any baggs they might<br /> goe onboard (meaning board the said rescued ship) and every one take<br /> a bushell of the said Rye, for a spending penny or<br /> to that Effect, And saith that presently after hee had<br /> soe said this deponent and some others went onshore to<br /> deale, to fill water, where this deponent stayed that day,<br /> and afterwards coming on board the said ffrigott hee sawe<br /> some Rye on board the said ffrigott in baggs which was<br /> not in her when hee soe went ashore, but saith that hee<br /> knoweth not how much they in all tooke out of the said rescued vessell<br /> nor the vallue thereof, And saith that hee hath heard severall<br /> of the said ffrigotts Company say that the said Captaine<br /> Poines that the said Captaine<br /> Poines  +
