Transcription Ad 12th artum deponit et dicit that the ReAd 12th artum deponit et dicit that the Rere(?) Admirall of the said shipp<br /> called ( as afterwards appeared ) the ''Zelandia'' and whereof one ty xxx Quarts<br /> was commander came sailing to the windward of the ''Experience'', which is<br /> contrary to the custome of friends at sea, and never hayled the ''E''-<br /> ''perience'' at all; whereupon Captain Kingsman seeing the same<br /> hayled the ship ''Zelandia'', and wished her Captain to keep to leeward<br /> of the ''Experience'' but the said(?) Captaine made no answer at all thereunto but<br /> sayled on still to windward of her as an enemy. And<br /> then and not before Captain Kingsman, according to the use and custome<br /> of the seas in the like case, caused a shot to be made from his<br /> ship the ''Experience'' athwart the ''Zelandia’s'' foot, which did neither<br /> touch the ''Zelandia'' nor was intended soe to doe, but was only<br /> ( as he sayth ) to give the said Quarts in the ''Zelandia'' notice of when<br /> to fall with his said ship to leeward of the ''Experience'', and not to be upon(?) of the<br /> weatherside of her, notwithstanding all which means used he sayth<br /> the said Captain Quarts kept to windward still of<br /> ''Experience'', and would not come to the Lee. The premisses he<br /> knoweth to be true seeing and hearing the same. Ad 13th Artum dicit that during all the time the ''Zelandia'' came(?)<br /> to windward of the ''Experience'' as aforesaid and before, the ''Experience'' had(?)<br /> up and sayled with the English Colours, and the Captain and Company<br /> of the ''Zelandia'' might and did see the same, And this Deponent<br /> verily beleeveth that they, and also the Companies of the two said(?)<br /> ships ( which were also very neare ) might and did very well<br /> perceive(?) and know the ''Experience'' to be an English ship. Et ate nescit.<br /> Ad 14th dicit that so soon as ever the ''Zelandia'' came up with the(?)<br /> ''Experience'', her Captain never hayled the ''Experience'' but xxxx<br /> gave her a broadside, and so lay ahead of her continually<br /> firing his guns, and spoyling the masts rigging tackle<br /> furniture of the ''Experience'', untill the other two Dutch ships(?)<br /> came up with her also. And sayth that when the other two<br /> Dutch ships ( called the ''Orange'' and the "Armes of Zealand" )<br /> soe came up they fired their Guns also at the ''Experience''<br /> and also poured small shot amongst her Company, by<br /> which their shooting they killed the said Captain Kingsman, one or<br /> two more of the Company of the ''Experience'', and then<br /> boarded and surprized her<br /> And after such surprizall and quarter given(?)<br /> he sayth that one of the Company of one of the foresaid Dutch<br /> ships in cold blood killed one of the ''Experience’s'' Company<br /> and they the said Companies of the Dutch ships plundered all(?)<br /> the xxxxxxxx of the ''Experience'' of all that belonged unto<br /> them, and tooke away all the papers and writings which<br /> were in the said ship and such as they found did concerne the<br /> ship and her lading and showed that the same did belong to Englishmen they either tore or threw overboard or<br /> caused them to be torne or throwne overboard and then<br /> (after severall other abuses done to the Company of the<br /> ''Experience'' ) carried her and her lading to xxxxx xxxx<br /> Gallicia, and there kept her about ten or twelve dayes during which(?) time(?)<br /> (contrary to the rules of the Law and Justice in such case(?))<br /> broke bulke and tooke out of her about two hundred and fifty<br /> chests of white sugar, and at least twelve hundred Rolls<br /> of Tobaccoe, and disposed thereof at their pleasure, and soe carried(?)<br /> theeasure, and soe carried(?)<br /> the  +
