assisted therein (and saith that while the said ship was<br />
soe unlading one that was called the Dutch Consull at Marsellis came onboard<br />
the said Ship and after the said winter and the said<br />
Dutch man had had some high words the said Dutch<br />
=man and the Master of the said Ship went out of the said Ship into a boate, and after<br />
they were got into the Boat the said winter held a<br />
Pistoll in his hand, threat'ning to shoote them if they<br />
did not come onboard, and by that meanes forced<br />
them both to come onboard, and after they were come<br />
onboard the said winter Commanded this deponent and<br />
another man to make the said man (called the Dutch<br />
Consull) fast to the maine Hellyards, which was done<br />
accordingly and this deponent by order of the said winter<br />
tooke away his knife, and hee being soe made fast<br />
the said winter did with his owne hand strike him<br />
with a stick, or ropes End, and to this deponents best remem=<br />
=brance hee gave him three blowes, And saith that<br />
about a month after the ''ffairfax'' did in Ligorne<br />
Road, take an other ship (but her name this deponent knoweth<br />
not, and Presently after her seizure the said Winter<br />
with severall of the ''ffarefax'' Company went onboard<br />
her, and broke open her hold, and tooke out<br />
very many goods, and this Deponent and some<br />
others were Imployed in carrying Copper<br />
Trunks, and Bales of Cloath from onboard the said<br />
seized Ship. onboard the ''ffairfax'', and saith that as the<br />
said Prize was comeing out of the Road of Leghorne<br />
a Dutch man of warr (which was their Convoy when shee was<br />
taken) came up, and seized upon her and carried her<br />
into the mould, and the said Winter when<br />
the said Man of warr was laying her board Did in a Cowardly<br />
manner goe away in a boate onboard the ''Fairefax''<br />
and saith that both the foresaid Ships soe taken were<br />
manned with Hollanders (and beleeveth the Ladings of<br />
the said Ships, or considerable Parts thereof was belonging<br />
to Spaniards and further deposeth not, saving hee heard<br />
that the said Winter for his misdemeanours was<br />
secured, and afterwards made his escape./

this Deponent knoweth of made any restitution of or satisfaction<br />
