said Anchor lay, was a very Convenient Place for a ships<br />
birth, and therefore not a fitting place for an Anchor to<br />
Lye in, and saith that masters and shippers of shipps doe<br />
not use to lay or Cast their Anchors in such places, neither<br />
ought they to doe, by the Lawes and Customes used in the<br />
River of Thames, And saith that by meanes of the said<br />
Anchor lying in the said place and without a buoy all the severall damages<br />
aforementioned came and happened, And not by any<br />
fault of or in the said Robert Clarke or any of the<br />
Company of the said ship. The Premisses hee deposeth<br />
for that hee this deponent was one of the said ships Company as<br />
aforesaid, and hath for along time. bin a seaman and frequented<br />
this Port, And further cannot depose/.
To the 11th hee saith that for the reasons aforesaid hee well knoweth<br />
that according to the Customes alsoe used in the said River noe Anchor or<br />
Anchors belonging to any ship or ships. ought to Lye in the said River above one<br />
Tyde without a buoy, And further deposeth not./,
To the 12th hee deposeth not./.
To the 13yth hee referreth himselfe to the Rehgistry of this Court.
To the 14th hee saith that hee beleeveth the said Clarke and Company<br />
by reason of the Premisses. hath suffered losse and damage to the<br />
vallue of ffifteene Pounds sterling. Onely for the use of the said<br />
money, and the losse of the Imployment of the said ship:/:
To the 15th and 16th hee referreth himselfe to his foregoeing deposition<br />
and the Lawe.
To the last hee saith his foregoeing deposition is true./.

To the 1st hee was Carpenter of the ''Warewell'' as aforesaid.
To the 2d hee saith the said shipp the ''Suzan'' (which this deponent knoweth)<br />
is of the burthen of about 220 Tonnes, and the place where<br />
she lay the time when the foresaid Damage was Done was a<br />
Convenient Place, and shee lat then neere Wapping Dock.
To the 3d and 4th hee saith that the ''Warewell'' came to an Anchor in the foresaid<br />
Place early in the morning of the said second of August last, it being<br />
then about three quarters floud or rather somewhat more, And<br />
the said ship ''Warewell'' sat upon the said Anchor<br />
when it was about three quarters ebb, and saith the ''Warewell''<br />
lay in the said Place about 16 houres before shee was bilged<br />
as aforesaid: And otherwise cannot Answer/.
To the 5th hee saith, hee was on board the ''Warewell'' when shee was first<br />
moored in the said Place and Did not goe out of her untill after<br />
the said bilging, and further doth not Answer./.
