pipes of wyne marked as aforesayd or the greatest part of them aboard<br />
the sayd ''Elizabeth'' and that the sayd ''Elizabeth'' with the sayd wines or [?XXXX]<br />
part of them aboard her was taken by the ''Bryar ffrigott'' a shipp in<br />
the imediate service of this Commonwealth and brought into the<br />
River of Thames and the reason of such his beleefe is for that hee sawe<br />
her the ''Elizabeth'' lyeing in the sayd river with about a hundred fort[?y]<br />
eight or a hundred and fiftie of the same pipes of wine which [?XXX]<br />
over taken from aboard the ''Mary and Joyce'' and put into the sayd<br />
''Elizabeth'', then and there aboard her the sayd ''Elizabeth'', and having still the [?same]<br />
markes as they had on their bungs at the tyme this deponent [?caused]<br />
them to bee first laden aboard the ''Mary and Joyce'' at the Canaries and the same<br />
as was and are in the bills of lading signed by the sayd Phillip<br />
Stafford the Master of the ''Mary and Joyce'', and alsoe the same<br />
Counter markes on the heads of each pipe as they had at their<br />
sayd first ladeing, and sawe them unladed out of the sayd<br />
shipp ''Elizabeth'' by order of this Court And further to those<br />
articles hee cannot depose/
To the 12th and 13th articles hee saith that at the tyme the ''Mary and''<br />
''Joyce'' and her sayd ladeing were brought into the Groyne the arlate<br />
Andrew [?A]ernonto was there Consull Generall for the subiects<br />
of the States of the United Provinces And there told and affirmed<br />
to this deponent that John da LaVilette and Nicholas [?XXXX]<br />
of Middleborough were Owners Armers setters firth and<br />
imployers of the sayd two frigotts or men of warr which [?soe]<br />
seized the sayd shipp ''Mary and Joyce'' and her ladeing And the<br />
sayd Aernonts there alsoe told this deponent that the arlate [?XXXX]<br />
Roe was there imployed by the sayd John da Lavillette and Nicholas<br />
Clements to dispose of such prizes as should bee taken by the sayd<br />
two friggotts or men of warr and brought in thither, whereupon the<br />
sayd Roe having whilest this deponent stayed at the Groyne landed<br />
eight or tenn pipes of wine from on board the ''Mary and Joyce'' [?and]<br />
some other goods belonging to the sayd Thomas Warren<br />
and him this deponent, hee this deponent did adresse himselfe to the sayd<br />
Roe and endeavour to compound with him for a hundred and fiftie pipes of the wines seized and then aboard the<br />
and [XXXX], and the sayd Roe thereupon told this deponent that what hee<br />
and this deponent should agree for must bee paid to the sayd da Lavillette<br />
or Clements or one of them at Middleborough, which in[XXXX]reth th[?is]<br />
deponent to beleeve that the sayd deLavillette and Clements were<br />
Owners Armers setters forth and imployers of the sayd two ffrigotts<br />
or men of warr, and the sayd Roe their Agent at the Groyne to [?dispose]<br />
