Nicholas Symons Master of her for the sayd voyage And fittted and<br />
sett her out to Sea for the sayd voyage at his the sayd Martines his<br />
cost And further to those articles hee cannot depose of certayne knowledge for<br />
that hee was not in the Brazeele when shee was fitted there the voyage<br />
in question for her returne thence to Lisbone, but beleeveth shee was<br />
there fitted alsoe for her returne at the cost and by the order of the sayd Martines<br />
or his Agents in Brazeele./
To the 4th article hee saith that hee well knoweth that the sayd John Martines<br />
Cascaes is an Inhabitant of Lisbone and a subiect of the King of<br />
Portugall and by Common reporte there was borne at Cascaes in the<br />
dominions of the sayd King whose subiect hee hath bin from his birth<br />
And further hee cannot depose
To the 5th hee saith hee cannot depose ought of certayne knowledge<br />
as touching the seizure of the sayd shipp the ''Nostra Seniora da Rosario''<br />
''Saint Gonsalvo'', for that hee was not aboard at her seizure but saith hee<br />
hath Credibly heard at Lisbone by publique report there the sayd<br />
shipp the voyage in question in her passage and Course from Braseele<br />
for Lisbone was togeather with her ladeing on the fifth of November last seized by a squadron of<br />
dutch shipps, and by dutch men, subiects of the States of the United Provinces<br />
who brought her and her ladeing to dartmouth, and this deponent<br />
having since his coming from Lisbone to England bin at dart=<br />
mouth in Lent last, there sawe the sayd shipp and ladeing under<br />
imbargo or arrest of this Court and was aboard her, and saith<br />
hee knoweth the sayd Martines is still proprietor of the sayd shipp<br />
and her tackle and hath heard and beleeveth that her ladeing did all belong<br />
to Portuguese Merchants subiects of the King of Portugall And<br />
beleeveth the sayd shipp and ladeing were soe imbargoed or arrested upon<br />
that point of the sayd Martines and others their proprietie therein And<br />
further to this article hee cannot depose
To the last hee saith his foregoeing deposition is true/
