Godolphin Doctor of Lawes one of the Judges of the high C[ourt GUTTER]<br />
of the Admiraltie and Examined on Certaine Interrogatories m[inistred GUTTER]<br />
on the behalfe of ffrancis Sumers of London Merchant saith and<br />
deposeth by vertue of his Oath:/:
To the first and 2d Interrogatories hee this deponent on the five and twen[tith GUTTER]<br />
day of July last 1657: was present in Company with the Interr[ate GUTTER]<br />
Mr ffrancis Somers and Mr James Powis, at the Signe of the<br />
Goate in ffinch Lane, at which time and place, and in this deponents<br />
heareing, the said ffrancis Sumers and James Powis Did [XXX GUTTER]<br />
and discourse of the summe of one hundred pounds which the said<br />
Mr Sumers had Assured the said Mr Powes upon the ''Saint Jacob''<br />
of Lubeck (hans Clauson Master) And the said Sumers did [XXX GUTTER]<br />
and there tell the said Powes, that hee the said Powis [had GUTTER]<br />
not delt fairely with him, about the said Assurance, for [at GUTTER]<br />
the time of the said Subscription of the Pollicy of Assurance<br />
hee had warranted the ship to be well and in good Condition<br />
when as hee had heard by three or foure other ships that<br />
came out from about Quinsborowe a little time after<br />
the ''Saint Jacob'' came thence, that shee was missing, and that they [XXX GUTTER]<br />
not tell what was become of her. or words to the very same effect<br />
To which the said James Powes made answer, and aacknowledged<br />
that hee did at the time of the Subscription of the said Pollicy by the<br />
said Mr Sumers warrant warrant that the said shipp was<br />
safe and well, and that hee had heard nothing to the Contrary<br />
at the time of the Subscription of the said Pollicy: but the<br />
said Sumers then urging to him the said Powis that hee<br />
had heard by 3 or 4 shipps that were arrived here [XXXX GUTTER]<br />
his putting in the said Pollicy that the said Vessell the ''Saint Jacob''<br />
was a missing ship, and that hee concealed the same [from GUTTER]<br />
him when he Subscribed the said Pollicy: The said [Sumers GUTTER]<br />
then acknowledged that hee had notice by some or one of the<br />
ships which arrived here before his èutting in the said [Pollicy GUTTER]<br />
that the ''Saint Jacob'' was a missing vessell, and that hee did<br />
not tell the said Newes to the Said Sumers; but said [I GUTTER]<br />
warranted you shee was well at the time of your Subscription<br />
and soe I beleeve, and doe alsoe now warrant you shee was<br />
and that is as much as I new to doe or words to the<br />
same effect; The Premisses hee deposetth and knoweth to<br />
be true, being present and hearing the Same And further<br />
hee cannot depose, saving there was alsoe one Keene and [XXXX GUTTER]<br />
and one or two more present, at the said time and place/:
