both the sayd shipps were chased all that thirteenth day and the night following<br />
by a dunkirke man of warr so that the articulate Noyes and Company the better to bee in a readinesse<br />
to defend them selves from seizure were constreyned to open their<br />
Ports by reason whereof the weather continueing still very tempestious<br />
and the sea running high, they sayd shipp tooke in much water at her<br />
Ports which could not be avoided for the reason aforesayd And<br />
the sayd shipp being by the sayd man of warrs chaseing of her put<br />
to the Northwards of Scilly, the sayd shipp the ''Plough'' to recover her<br />
way and keepe her from the Lee shoare was forced to leave<br />
very pressed sayle, by reason whereof the winde being very high<br />
and the sea tempestious the Company of the ''Plough'' were forced to open their hatches<br />
to take up their Cables and bend them to their Anchors that they might<br />
bee in a readinesse upon all occasion, by which meanes the sayd<br />
shipp tooke in much water at her hatchway, which could not alsoe<br />
be avoided for the reason aforesayd for that they were forced to open<br />
them in order to the better preservation of the shipp, her ladeing and<br />
their lives, These premisses hee deposeth of his owne sight and<br />
knowledge And further to these articles hee cannot depose./
To the 3 hee saith that hee being Carpenter of her as aforesayd knoweth<br />
that the shipp ''Plough'' during the whole voyage in question while<br />
the stormes and casualtyes predeposed of happened was a strong tight<br />
and stanch shipp for the imployment shee was in and soe still in since<br />
her coming home And well knoweth that what dammage is happened<br />
to her ladeing came not through any insufficience of the shipp<br />
nor want of diligence and industrie of her master and company to prevent the<br />
the same (who hee well knoweth laboured all they could to save<br />
her and her ladeing from dammage and to secure their own lives) but<br />
meerely by the stormie and tempestious weather and casualteyes<br />
aforesayd And saith hee is well assured that had not the sayd<br />
Master and company bin very active and laborious the sayd shipp<br />
and her ladeing and Company had perished in the Sea or bin taken<br />
by her the sayd man of warr And further hee cannot depose/
To the last hee saith his foregoeing deposition is true./
