To the fifth article he deposeth and saith … To the fifth article he deposeth and saith that he this<br />
deponent was aboard the arlate shipp the ''ffortune'' of<br />
Topsham, in the Bay of Cadiz when she was fully<br />
laden, and therby well knoweth that there were<br />
then aboad the said shipp nor more or other hogsheads<br />
then onely the interrogated hogsheads of sherry wines<br />
laden aboard her by the said Mr Beesley the producent<br />
predeposed of, And further he cannot depose.
To the sixth article he deposeth and saith that two hogsheads<br />
of Sherry wines goes to a Butt, and that it did<br />
appeare by the sayd Marshalls accompt predeposed of<br />
that he did or had made 23 or 24 ''li'' a butt of the<br />
24 butts of sherry wines, which he had possessed himselfe<br />
of and were the goods of the producent as is predeposed<br />
And further he cannot depose.
To the seaventh aarticle he deposeth and saith that had the<br />
said 19 hogsheads of sherry wines bin delivered (according to the bill of lading)<br />
untothe sayd Mr Mayne and the proceed thereof made<br />
use of unto the producents profitt fifty pounds<br />
might (by this time have bin gayned, And further<br />
he cannot depose.
To the eighth he referreth himselfe to the Registry and<br />
the acts of Court.
To the last he saith his former deposition is true.
To the Interrogatories. [CENTRE HEADING]
Too the first Interrogatory he answereth that he did never see<br />
the interrogated shipp before she lay in the bay of Cadiz<br />
to take in her lading of the Sherree wines predeposed<br />
of And tio the rest negatively./
To the second Interrogatory he answereth that the interrogated<br />
Thomas Crocker did sayle in the sayd shipp for<br />
the bay of Cadiz into England And to the rest<br />
negatively.
To the third Interrogatory he answereth that besides the [?XXX GUTTER]<br />
butts and 19 hogshead of wines laden aboard the shipp<br />
interrogated by the producent, there were 37 butts and a<br />
halfe laden aboard the said shipp by Mr [?Ambrose GUTTER]<br />
Canham, which 37 butts and a halfe Mr John [?Willmott GUTTER<br />
this deponents Master after their lading and before the<br />
said shipps going out of Cadiz=bay, bought, and alsoe<br />
there were 20ty butts of sherry wines laden aboard<br />
the sayd shipp for the accompt of Mr George C[?XXX GUTTER]<br />
And further or otherwise referring himselfe to his foregoing<br />
deposition he cannot answeare
