Exámined upon the foresaid allegation.

aged 33 yeeres or thereabouts, sworne and exámined.
To the third árticle of the said allegation (upon which alone hee is<br />
by direction of the producent exámined) hee saith and<br />
deposeth That the arlate Edward Lander (sometime before the<br />
arival of the ''Justice'' arlate) retourning to this citie from Berghen<br />
in Norway, and having occasion shortly after to goe to Bristol, told<br />
this deponent that hee had freighted<br />
the said shipp the ''Justice'' at Berghen to bring<br />
goods thense hether, and did expect her arivall, and desired<br />
this deponent upon her arivall, to send him downe word to<br />
Bristol, which this deponent accordingly did by letter,<br />
written by this deponent and sent away about<br />
eight dayes after such arivall of the said shipp, And saith that<br />
Mr Lander comming to towne and meeting with this deponent<br />
told him, that Mr Southwood (speaking of John Southwood<br />
partie in this suite) had not written to the said Mr Lander<br />
of the said shipps arivall - till after this deponents writing<br />
(which was not till eight dayes after the said shipps arivall<br />
as aforesaid) and that this deponents letter was the first<br />
which then hee had of the shipps comming; and that further<br />
that mr Southwood had received the goods or most part thereof<br />
before the said Landers comming up, and for his part hee [?would GUTTER]<br />
not meddle with them, for hee was but a factor in the said<br />
cargo, for Alderman hooke and the said mr Southwood, and<br />
severall times before the said Lannders going hense for Norway<br />
the said voyage wherein hee laded the said goods aboard the ''Justice''<br />
hee told this deponent that hee was going the same only as<br />
factor to the said Alderman and mr Southwood aforesaid<br />
And this deponent verily beleeveth that hee was only a factor<br />
therein, and that the said Southwood received the said goods for<br />
account of himselfe and mr Alderman hooke, and [?nothing GUTTER]<br />
thereof for the said Lannders account, and therefore hee<br />
ought (as this deponent conceiveth) to pay the freight for<br />
transportation thereof. And for the further manifestation of<br />
the said Southwoods proprietie, hee saith that mr Southwood had<br />
sold severall parcells of the said goods to severall persons, and<br />
that at such time as mr Lannder was here, who left the<br />
businesse and did not meddle therein, namely the said Southwood<br />
sold tarr to mr Greene, and Timber and deales to [?Mr GUTTER]<br />
Morris, which goods came out of the said shipp. And otherwise hee<br />
cannot depose.

To the first hee saith hee well knoweth the Interrate John Southwood

and hath soe donne about two yeares, and saith hee did not see Mr Southwood receave any of the goods in question and otherwise<br />
hee cannot answer saving as aforesaid.
To the second hee saith hee knoweth nothing thereof, and therefore cannot answer thereto.
To the third negatively for his part, and otherwise cannot depose.
To the fourth hee saith hee knoweth the said Launders, and for his part hee answereth negatively saving his<br />
foregoing deposition, and saving the same hee cannot depose.
To the fifth hee saith hee knoweth the interrate Peter Johnson who as hee saith hee came to this deponent<br />
with a note from mr Lemkuel, whereby mr Lemkuel wrote to this deponent to come and be sworne to speake<br />
the truth in this matter, and otherwise negatively for his part, and further cannot answer.
