To the 8th hee saith that in case the sayd … To the 8th hee saith that in case the sayd Jagoe and Bowtill had not kept<br />
the sayd shipp at dartmouth under pretence of imploying her as aforesayd<br />
hee this deponent well knoweth shee might have bin imployed upon other<br />
voyages which would (in the tyme shee was soe there kept by them under<br />
pretence aforesayd) have profitted the sayd Nathaniell Marriott as much<br />
or more then the sayd Bowtill and Jagoes Imployment would have done<br />
for hee this deponent knoweth that in Ireland before her coming thence to<br />
dartmouth to be imployed by the sayd Bowtill and Jago according to Charter=<br />
party, there were severall imployments offered to this deponent by merchants<br />
in Ireland to goe for Bristoll and for Portugal and other parts beyond the seas<br />
which would have bin very advantagious, all which this deponent durst<br />
not accept of but came dead freighted from Ireland to dartmouth in-<br />
August 1655 that hee might performe the sayd Nathaniell Marriotts<br />
engagement by Charterparty to the sayd Bowtill and Jagoe<br />
And further to this article hee cannot depose/
To the 9th hee saith that the arlate Marriott by reason of the sayd<br />
Bowtill and Jago their not performance of Covenants in manner<br />
aforesayd and not imploying the sayd shipp according to Charterparty<br />
hath in his deponents Judgement and estimate (and as hee verily beleeveth<br />
and is perswaded in his conscience) suffered losse and damage to the<br />
value of three hundred pounds sterling at the least<br />
shee having of this deponents<br />
knowledge only made one voyage for ffrance (this deponent goeing Master of her)<br />
the freight whereof came to forty two pounds sterling which was all the<br />
voyages this deponent could get for her since And further hee<br />
cannot depose./
To the 10th hee saith the sayd Jagoe that bin by this deponent and<br />
his contest Thomas Marriott required on behalf of the sayd<br />
Nathaniell Marriott to give satisfaction to the sayd Nathaniell for<br />
the losse by him susteyned by their meanes, in manner aforesayd<br />
which hee hath delayed and refused to doe And further hee cannot<br />
depose./
To the 11th hee saith the arlate Jago is a Merchant living at<br />
dartmouth and the sayd Bowtill (as hee hath heard and beleeveth) a-<br />
Merchant of London, and hee beleeveth they are both Englishmen and<br />
subiects of this Commonwealth and subiect to the authority of this Court<br />
And further hee cannot depose
To the last hee saith his foregoeing deposition is true
